1. Generalidades	1. General
1.1. Estos Términos de Servicio constituyen un acuerdo ("Acuerdo") entre usted ("Usted", "Usuario" o "Conductor") y Diamond Mobility Operations OÜ, sociedad fundada con arreglo a las normas de la República de Estonia, bajo el número de registro 17591324 y domicilio fiscal en Vana-Lõuna tn 15, Tallinn 10134, así como sus subsidiarias, filiales, representantes, agentes, etcétera, con respecto a su uso de:	1.1. These Terms of Service constitute an agreement ("Agreement") between you ("You", "User" or "Driver") and Diamond Mobility Operations OÜ, a company incorporated under the laws of the Republic of Estonia, with registration number 17591324 and registered office at Vana-Lõuna tn 15, Tallinn 10134, together with its subsidiaries, affiliates, representatives, agents, etc., in respect of your use of:
1.1.1. cualquier vehículo impulsado por humanos y asistido eléctricamente disponible en la Aplicación, como patinetes eléctricos y bicicletas eléctricas (en conjunto, "Vehículos Eléctricos");	1.1.1. any human-powered, electrically-assisted vehicle available on the App, such as electric scooters and electric bicycles (together, the "Electric Vehicles");
1.1.2. Nuestra aplicación móvil para acceder a los Vehículos Eléctricos y utilizarlos (“Aplicación”); y,	1.1.2. Our mobile application for accessing and using the Electric Vehicles (the "App"); and
1.1.3. otros servicios relacionados, tales como la carga, mantenimiento, recogida y servicios similares ("Servicios Relacionados") que ponemos a su disposición (los Vehículos Eléctricos, la Aplicación y los Servicios Relacionados se denominan conjuntamente como, los "Servicios").	1.1.3. other related services, such as charging, maintenance, collection and similar services ("Related Services") that we make available to you (the Electric Vehicles, the App and the Related Services are together referred to as the "Services").

1.3. Los siguientes documentos son vinculantes y forman parte del presente Acuerdo:	1.3. The following documents are binding and form part of this Agreement:
1.3.1. la normativa de uso de los Vehículos Eléctricos, incluida como Anexo A al presente Acuerdo (“Normas Generales de Conducción”);	1.3.1. the rules for the use of the Electric Vehicles, included as Annex A to this Agreement (the "General Driving Rules");
1.3.2. las pautas de seguridad relacionadas con el uso de Vehículos Eléctricos mostradas en la aplicación y, según el caso, en las herramientas de seguridad de la Aplicación ("Herramientas de Seguridad");	1.3.2. the safety guidelines relating to the use of the Electric Vehicles shown in the app and, where applicable, in the App’s safety tools (the "Safety Tools");
1.3.3. el esquema de tarifas aplicable como se muestra en la Aplicación (el "Esquema de Tarifas"), cualquier otra información de precios, normativa mostrada en la Aplicación en relación con el Pase Básico y el Pase por Paquete (definidos en 4.1), cualquier condición aplicable de Códigos Promocionales, así como instrucciones, manuales (incluyendo, en su caso, el Manual del Usuario del Vehículo Eléctrico) y otras pautas mostradas en la Aplicación; y	1.3.3. the applicable fare schedule as shown in the App (the "Fare Schedule"), any other pricing information, rules shown in the App relating to the Basic Pass and the Package Pass (defined in 4.1), any applicable conditions for Promotional Codes, as well as instructions, manuals (including, where applicable, the Electric Vehicle User Manual) and other guidelines shown in the App; and
1.3.4. cualquier otra condición comercial y de productos referida en el presente Acuerdo, tales como descripciones de servicios, políticas y notificaciones, incluyendo Nuestra Política de Privacidad para Pasajeros (“Política de Privacidad”), que está disponible en la Aplicación o en: , y se aplicarán respectivamente (mutatis mutandis) al procesamiento de sus datos personales en relación con el uso de los Servicios;	1.3.4. any other commercial and product terms referred to in this Agreement, such as service descriptions, policies and notices, including Our Passenger Privacy Policy (the "Privacy Policy"), available on the App or at: https://bolt.eu/legal/, which shall apply respectively (mutatis mutandis) to the processing of your personal data in connection with your use of the Services;
1.3.5. condiciones complementarias específicas de cada país o ciudad (“Área de Servicio”) aplicables en el área de conducción.	1.3.5. supplementary conditions specific to each country or city (the "Service Area") applicable in the driving area.
1.4. Según Nuestros Servicios evolucionen, Nos reservamos el derecho de realizar cambios en este Acuerdo mediante la publicación del Acuerdo modificado o sus condiciones complementarias en Nuestra página web o en la Aplicación, asimismo, se lo notificaremos a través de la dirección de correo electrónico proporcionada durante su registro. Si continúa utilizando los Servicios después de la publicación del Acuerdo actualizado, se entenderá que Usted otorga su consentimiento para quedar vinculado por el Acuerdo en su versión modificada.	1.4. As Our Services evolve, We reserve the right to make changes to this Agreement by publishing the amended Agreement or its supplementary conditions on Our website or in the App; We will also notify you via the email address provided during registration. If you continue to use the Services after publication of the updated Agreement, you will be deemed to consent to be bound by the Agreement as amended.
2. Uso de la Aplicación	2. Use of the App
2.1. Los Servicios se usan a través de la Aplicación. La Aplicación está disponible en múltiples idiomas que pueden ser cambiados en su perfil. La Aplicación permite a las personas que necesitan transporte encontrar un Vehículo Eléctrico compartiendo su ubicación geográfica. Para brindarle nuestros Servicios, podemos rastrear la ubicación de su dispositivo a través de la Aplicación. Puede haber restricciones para la prestación de Servicios en función de la ubicación de su dispositivo. Estas restricciones son evidentes a través de la interfaz de la aplicación. No proporcionamos Servicios en todas las jurisdicciones. Dado que la disponibilidad de nuestros Servicios puede cambiar ocasionalmente, no existe una lista final de jurisdicciones.	2.1. The Services are used through the App. The App is available in multiple languages, which can be changed in your profile. The App allows people who need transport to find an Electric Vehicle by sharing their geographic location. In order to provide you with our Services, we may track your device’s location through the App. There may be restrictions on the provision of Services depending on your device’s location. Such restrictions are apparent through the app interface. We do not provide Services in all jurisdictions. Since the availability of our Services may change from time to time, there is no definitive list of jurisdictions.
2.2. El uso de los Servicios requiere la instalación de la Aplicación y crear una cuenta de usuario (“Cuenta”). Durante la instalación de la Aplicación, su número de teléfono móvil se vinculará a su Cuenta y se incorporará a Nuestra base de datos.	2.2. Use of the Services requires installation of the App and creating a user account (the "Account"). During installation of the App, your mobile phone number will be linked to your Account and added to Our database.
2.3. Es posible que actualicemos la aplicación de vez en cuando para brindarle el mejor servicio posible. Los servicios disponibles a través de la aplicación solo son accesibles con una conexión a Internet. No existen requisitos técnicos específicos para la conexión a Internet, sin embargo, la calidad del servicio puede verse afectada por la velocidad de Internet. La Aplicación está disponible en dispositivos Android y Apple de acuerdo con las últimas actualizaciones de software.	2.3. We may update the app from time to time to provide you with the best possible service. The services available through the app are only accessible with an Internet connection. There are no specific technical requirements for the Internet connection; however, service quality may be affected by Internet speed. The App is available on Android and Apple devices in accordance with the latest software updates.
2.4. En caso de que la Aplicación presente algún defecto, nos comprometemos a corregirlo lo antes posible; sin embargo, Usted reconoce que la funcionalidad de la Aplicación puede verse limitada debido a errores técnicos ocasionales y que no podemos garantizar un funcionamiento continuo y sin fallos en todo momento. No asumimos responsabilidad alguna por las pérdidas que puedan derivarse del hecho de que la Aplicación no funcione o no pueda utilizarse de la forma deseada, en la máxima medida permitida por la legislación aplicable.	2.4. Should the App present any defect, we undertake to correct it as soon as possible; however, you acknowledge that the App’s functionality may be limited due to occasional technical errors and that we cannot guarantee continuous, fault-free operation at all times. We assume no liability for losses that may arise from the App not working, or not being usable in the desired manner, to the maximum extent permitted by applicable law.
2.5. Sujeto a su cumplimiento del Acuerdo, le otorgamos una licencia limitada, no exclusiva, no sublicenciable, revocable e intransferible para acceder a la Aplicación y utilizarla en su dispositivo personal únicamente en relación con su uso de los Servicios.	2.5. Subject to your compliance with the Agreement, we grant you a limited, non-exclusive, non-sublicensable, revocable and non-transferable licence to access and use the App on your personal device solely in connection with your use of the Services.
2.6. Los Servicios han sido diseñados y entregados en cumplimiento de los estándares y las mejores prácticas de la industria, tales como ISO 27001/27002, siempre que sea posible y no entren en conflicto con otros requisitos acordados. Si se procesan datos de tarjetas de crédito, también se cumplirá con el Estándar de Seguridad de Datos de la Industria de Tarjetas de Pago.	2.6. The Services have been designed and delivered in compliance with industry standards and best practices, such as ISO 27001/27002, wherever possible and provided this does not conflict with other agreed requirements. Where credit card data is processed, the Payment Card Industry Data Security Standard will also be complied with.
3. Requisitos aplicables al Usuario y Cuentas	3. User and Account Requirements
3.1. Usted podrá utilizar los Servicios si cumple con los siguientes requisitos:	3.1. You may use the Services if you meet the following requirements:
3.1.1. Usted tiene una Cuenta;	3.1.1. You have an Account;
3.1.2. Su cuenta está vinculada con una tarjeta de crédito o débito válida u otro método de pago compatible con la Aplicación, como, Cuenta Bolt Business o Cuenta Familiar ("Método de Pago Elegido");	3.1.2. Your account is linked to a valid credit or debit card or another payment method compatible with the App, such as a Bolt Business Account or Family Account (the "Chosen Payment Method");
3.1.3. No es menor de 18 años y está legalmente autorizado para conducir Vehículos Eléctricos de conformidad con la Legislación Local para el uso de los Vehículos Eléctricos disponibles en su Área de Servicio;	3.1.3. You are not under 18 years of age and are legally authorised to drive Electric Vehicles in accordance with the Local Legislation applicable to the use of the Electric Vehicles available in your Service Area;
3.1.4. Es titular de un permiso de conducir válido en el Área de Servicio en el que haga uso de los Servicios, si tal permiso es obligatorio para el uso del Vehículo Eléctrico;	3.1.4. You hold a valid driving licence in the Service Area in which you use the Services, if such a licence is required for use of the Electric Vehicle;
3.1.5. Usted tiene la capacidad física, así como las habilidades y conocimientos necesarios para utilizar, conducir y operar los Vehículos Eléctricos de manera segura y competente.	3.1.5. You have the physical capacity, as well as the skills and knowledge necessary, to safely and competently use, drive and operate the Electric Vehicles.
3.1.6. Usted acepta que es y será el único usuario de su cuenta, salvo lo permitido para los Viajes en Grupo según lo establecido en la Sección 4.6 más adelante.	3.1.6. You agree that you are and will remain the sole user of your account, except as permitted for Group Trips as set out in Section 4.6 below.
3.2. Al crear y usar su cuenta, Usted:	3.2. When creating and using your account, you:
3.2.1. acepta usar únicamente su nombre real, información personal y de la tarjeta adecuada, para la configuración de la Cuenta, así como mantener dicha información actualizada en todo momento;	3.2.1. agree to use only your real name and accurate personal and card information when setting up your Account, and to keep such information up to date at all times;
3.2.2. acepta que se le podrá solicitar que demuestre su identidad facilitándonos una fotografía de su permiso de conducir o de un documento de identificación nacional para obtener o mantener el acceso a los Servicios;	3.2.2. agree that you may be asked to prove your identity by providing us with a photograph of your driving licence or a national identification document in order to obtain or maintain access to the Services;
3.2.3. será responsable del acceso, control y seguridad de su Cuenta, así como: (i) del nombre de usuario y contraseña de su Cuenta; y (ii) de las acciones que se lleven a cabo con su Cuenta, como, por ejemplo, activación (desbloqueo), uso, desactivación (finalización de su viaje) y aparcamiento adecuado de los Vehículos Eléctricos, de conformidad con el presente Acuerdo y según sea el caso en el Área de Aparcamiento Permitido, o aparcamiento inadecuado, salvo si Usted ha notificado del uso inadecuado de su Cuenta conforme a lo dispuesto en el apartado 3.2.4. Consideraremos que cualquier tercero que utilice su nombre de usuario y contraseña ha sido autorizado por Usted para efectuar dicho uso;	3.2.3. will be responsible for the access, control and security of your Account, including: (i) your Account username and password; and (ii) actions carried out using your Account, such as, for example, activation (unlocking), use, deactivation (ending your trip) and proper parking of the Electric Vehicles, in accordance with this Agreement and, where applicable, within the Permitted Parking Area, or improper parking, unless you have reported the improper use of your Account in accordance with clause 3.2.4. We will consider that any third party using your username and password has been authorised by you to do so;
3.2.4. acepta notificarnos inmediatamente de cualquier acceso a su Cuenta o uso no autorizado de ésta o de cualquier otra situación que pueda conducir a la pérdida de control de su Cuenta;	3.2.4. agree to notify us immediately of any access to or unauthorised use of your Account, or of any other situation that could lead to the loss of control of your Account;
3.2.5. acepta que tenemos el derecho a suspender, restringir o desactivar su cuenta en la medida requerida para (i) asegurar el uso legal de la Aplicación, lo que incluye, entre otros, para prevención de fraude, evaluación de riesgos, investigación y propósitos de atención al cliente; (ii) garantizar su cumplimiento con este Acuerdo, las Reglas de Conducción y las Herramientas de Seguridad; (iii) cumplir con la ley aplicable u orden judicial, de la policía u otra institución administrativa u organismo gubernamental; o (v) según lo establecido en el presente Acuerdo;	3.2.5. agree that we have the right to suspend, restrict or deactivate your account to the extent required to (i) ensure lawful use of the App, including, among other things, for fraud prevention, risk assessment, investigation and customer service purposes; (ii) ensure your compliance with this Agreement, the Driving Rules and the Safety Tools; (iii) comply with applicable law or an order from a court, the police or another administrative institution or government body; or (v) as otherwise provided in this Agreement;
3.2.6. acepta que podemos enviarle mensajes de texto (SMS), notificaciones automáticas y mensajes de correo electrónico en relación con los Servicios prestados.	3.2.6. agree that we may send you text messages (SMS), push notifications and emails in connection with the Services provided.
4. Uso de los Vehículos Eléctricos	4. Use of the Electric Vehicles
4.1. Al desbloquear el Vehículo Eléctrico por medio de la Aplicación, Usted acepta alquilar el Vehículo Eléctrico en base a pago por uso (“Pase Básico”) o mediante un paquete prepagado (“Pase por Paquete”), sujeto a las condiciones de este Acuerdo y de conformidad con el Esquema de Tarifas aplicable durante el periodo de alquiler.	4.1. By unlocking the Electric Vehicle through the App, you agree to rent the Electric Vehicle on a pay-as-you-go basis (the "Basic Pass") or through a prepaid package (the "Package Pass"), subject to the terms of this Agreement and in accordance with the applicable Fare Schedule during the rental period.
4.2. Cada vez que Usted desbloquea el Vehículo Eléctrico y comienza el viaje, certifica y acepta expresamente que declara y garantiza haber leído y comprendido:	4.2. Each time you unlock the Electric Vehicle and start a trip, you expressly certify and agree that you represent and warrant having read and understood that:
4.2.1. Cumplirá todas las leyes y regulaciones de tráfico aplicables;	4.2.1. You will comply with all applicable traffic laws and regulations;
4.2.2. Ha leído, comprendido y cumplirá con las Normas Generales de Conducción en el Anexo A, la Legislación Local aplicable en el Anexo B, las Herramientas de Seguridad y cualquier otro término y condición aplicable para el Área de Servicio;	4.2.2. You have read, understood and will comply with the General Driving Rules in Annex A, the applicable Local Legislation in Annex B, the Safety Tools and any other applicable terms and conditions for the Service Area;
4.2.3. Cumple con las condiciones de elegibilidad establecidas en la Sección 3.1;	4.2.3. You meet the eligibility conditions set out in Section 3.1;
4.2.4. No manipulará el Vehículo Eléctrico, ningún dispositivo GPS a bordo, ni ninguna otra tecnología o equipo relacionado con el Servicio.	4.2.4. You will not tamper with the Electric Vehicle, any on-board GPS device, or any other technology or equipment related to the Service.
4.3. Al desbloquear el Vehículo Eléctrico, Usted acepta y se compromete a:	4.3. By unlocking the Electric Vehicle, you agree and undertake to:
4.3.1. que el Vehículo Eléctrico, y cualquier equipo conectado a éste, sigue siendo, en todo momento, Nuestra propiedad, y que Usted no desmantelará, modificará, reparará, destrozará o dañará de ninguna manera el Vehículo Eléctrico ni ningún equipo conectado a éste;	4.3.1. acknowledge that the Electric Vehicle, and any equipment connected to it, remains Our property at all times, and that you will not dismantle, modify, repair, wreck or damage the Electric Vehicle or any equipment connected to it in any way;
4.3.2. usar el Vehículo Eléctrico de conformidad con lo dispuesto en el presente Acuerdo, incluyendo las Normas Generales de Conducción y cualquier manual y directriz incluida en la Aplicación, y con las condiciones aplicables a su Área de Servicio;	4.3.2. use the Electric Vehicle in accordance with the provisions of this Agreement, including the General Driving Rules and any manual or guideline included in the App, and with the conditions applicable to your Service Area;
4.3.3. no permitir a terceros utilizar un Vehículo Eléctrico que haya sido desbloqueado por Usted, excepto como parte de un Viaje en Grupo según se define en este Acuerdo;	4.3.3. not allow third parties to use an Electric Vehicle that has been unlocked by you, except as part of a Group Trip as defined in this Agreement;
4.3.4. asumir plena responsabilidad del cuidado del Vehículo Eléctrico durante el periodo de alquiler y devolver el Vehículo Eléctrico en la misma condición en que se alquiló, a un área de estacionamiento permitida de acuerdo con la Legislación Local, el tipo de Vehículo Eléctrico y las instrucciones de estacionamiento especificadas en la Aplicación (“Área de Aparcamiento Permitida”). En caso de que el Vehículo Eléctrico se devolviese dañado o en mal estado, se le aplicará a Usted un cargo equivalente al coste de la reparación, según lo establecido en el apartado 5.62.	4.3.4. assume full responsibility for the care of the Electric Vehicle during the rental period and return the Electric Vehicle in the same condition in which it was rented, to a parking area permitted in accordance with the Local Legislation, the type of Electric Vehicle and the parking instructions specified in the App (the "Permitted Parking Area"). Should the Electric Vehicle be returned damaged or in poor condition, you will be charged a fee equivalent to the cost of the repair, as set out in clause 5.62.
4.4. Si el Vehículo Eléctrico se descarga totalmente durante el periodo de alquiler, Usted deberá interrumpir su viaje, según las instrucciones de la Aplicación y las condiciones de este Acuerdo, y aparcar el Vehículo Eléctrico en el Área de Aparcamiento Permitida.	4.4. If the Electric Vehicle’s battery becomes fully depleted during the rental period, you must end your trip in accordance with the App’s instructions and the terms of this Agreement, and park the Electric Vehicle in the Permitted Parking Area.
4.5. Usted debe informarnos inmediatamente de cualquier accidente, choque, daño, lesión personal, robo o pérdida del Vehículo Eléctrico de conformidad con el apartado 10.1 tan pronto como sea posible de manera segura. En caso de lesiones personales, daño de la propiedad o robo del Vehículo Eléctrico, Usted deberá informar al departamento de policía local dentro de las 24 horas siguientes al incidente.	4.5. You must inform us immediately of any accident, collision, damage, personal injury, theft or loss of the Electric Vehicle in accordance with clause 10.1, as soon as it is safely possible to do so. In the event of personal injury, property damage or theft of the Electric Vehicle, you must report it to the local police department within 24 hours of the incident.
4.6. En determinadas Áreas de Servicio, podemos permitirle a usted ("Anfitrión") desbloquear varios Vehículos Eléctricos con su Cuenta al mismo tiempo para su uso por parte de pasajeros invitados ("Invitados") para participar en un viaje en grupo ("Viaje en Grupo"). La función de Viaje en Grupo se mostrará en la Aplicación en función de la disponibilidad. El Anfitrión reconoce que los descuentos, promociones y otros créditos o incentivos no serán aplicables a ningún Viaje en Grupo. Al utilizar la función Viaje en Grupo, el Anfitrión acepta y se compromete a:	4.6. In certain Service Areas, we may allow you (the "Host") to unlock several Electric Vehicles with your Account at the same time for use by invited passengers (the "Guests") to take part in a group trip (a "Group Trip"). The Group Trip feature will be shown in the App depending on availability. The Host acknowledges that discounts, promotions and other credits or incentives will not apply to any Group Trip. By using the Group Trip feature, the Host agrees and undertakes to:
4.6.1. poner el dispositivo móvil del Anfitrión a disposición de cada Invitado para que lea personalmente, acepte y cumpla todas las disposiciones aplicables del presente Acuerdo, Nuestra Política de Privacidad, las Normas Generales de Conducción y las Herramientas de Seguridad.	4.6.1. make the Host’s mobile device available to each Guest so that they can personally read, accept and comply with all applicable provisions of this Agreement, Our Privacy Policy, the General Driving Rules and the Safety Tools.
4.6.2. garantizar que todos los Invitados tengan al menos 18 años de edad y cumplan las condiciones de elegibilidad enumeradas en las secciones 3.1.4 y 3.1.5 anteriores.	4.6.2. ensure that all Guests are at least 18 years of age and meet the eligibility conditions listed in sections 3.1.4 and 3.1.5 above.
4.6.3. autorizarnos a cargar a la Forma de Pago Elegida vinculada a la Cuenta del Anfitrión todas las tasas y cargos asociados a los Servicios prestados en el transcurso de la Viaje en Grupo.	4.6.3. authorise us to charge the Chosen Payment Method linked to the Host’s Account for all fees and charges associated with the Services provided during the Group Trip.
4.6.4. asumir toda la responsabilidad por los daños, pérdidas y lesiones causados por la conducta culpable de los Invitados durante el uso de los Servicios.	4.6.4. assume full responsibility for damages, losses and injuries caused by the wrongful conduct of the Guests while using the Services.
4.6.5. asumir toda la responsabilidad por las multas, tasas, penalizaciones y/o cualquier otro cargo que resulte del uso de cualquiera de los Vehículos Eléctricos desbloqueados en el Viaje en Grupo, o como resultado de que los Invitados aparquen un Vehículo Eléctrico de forma inadecuada o como resultado de que un Invitado infrinja cualquier ley, norma, reglamento u ordenanza mientras utiliza los Servicios (colectivamente, “Sanciones de Invitados”), en la máxima medida permitida por la ley aplicable. Usted acepta que podemos pagar todas las Sanciones de Invitados emitidas a Nosotros directamente, emitidas a Nosotros en su nombre o en nombre de su Invitado, y que tenemos derecho a un reembolso de estos montos más una tarifa administrativa razonable que no excederá los 30 EUR (“Tarifa Administrativa”).	4.6.5. assume full responsibility for fines, fees, penalties and/or any other charge resulting from the use of any of the Electric Vehicles unlocked during the Group Trip, or resulting from Guests parking an Electric Vehicle improperly, or from a Guest breaching any law, rule, regulation or ordinance while using the Services (collectively, "Guest Penalties"), to the maximum extent permitted by applicable law. You agree that we may pay all Guest Penalties issued to Us directly, issued to Us on your behalf or on behalf of your Guest, and that we are entitled to reimbursement of these amounts plus a reasonable administrative fee not exceeding EUR 30 (the "Administrative Fee").
5. Pago y tarifas	5. Payment and Fees
5.1. Usted puede utilizar nuestros Servicios por medio de un Pase Básico o un Pase por Paquete, si está disponible. Se le cobrarán tarifas por el uso del Vehículo Eléctrico y de los Servicios, de conformidad con nuestro Esquema de Tarifas y el tipo de Vehículo Eléctrico. El uso del Vehículo Eléctrico comienza al pulsar en “Desbloquear” y termina al pulsar en “Finalizar su viaje” (o botón(es) equivalente(es) de la Aplicación). Nuestras tarifas y otros cargos podrán estar sujetos a los impuestos aplicables y otros cargos locales, que Nosotros gravaremos y recaudaremos.	5.1. You may use our Services through a Basic Pass or a Package Pass, if available. You will be charged fees for the use of the Electric Vehicle and the Services, in accordance with our Fare Schedule and the type of Electric Vehicle. Use of the Electric Vehicle begins when you press "Unlock" and ends when you press "End trip" (or equivalent button(s) in the App). Our fares and other charges may be subject to applicable taxes and other local charges, which We will levy and collect.
5.2. En ciertas Áreas de Servicio, puede tener la opción de adquirir Servicios a través de un Pase por Paquete. In certain Service Areas, you may have the option to purchase Services through a Package Pass. Before completing your purchase, the applicable terms, limitations and pricing conditions of the Package Pass will be clearly and prominently displayed in the App. You must read and accept these terms before making the purchase. Package Passes cannot be used together with promotional offers, rewards or other discounts. Purchasing a Package Pass does not guarantee the availability of the Services. Package Passes will expire on the expiry date indicated, at the time of purchase, in the applicable pricing terms and conditions.

In certain Service Areas, Package Passes are available for purchase as subscriptions that renew automatically unless cancelled. Before completing your purchase, we will clearly inform you of the length of the renewal term (e.g., weekly, monthly), the subscription price, including applicable taxes, and instructions on how to cancel your subscription. By completing your purchase and providing your affirmative consent (for example, by clicking "Subscribe" or similar wording), you acknowledge and agree that your Chosen Payment Method will be charged the subscription fee at the start of each renewal period until you cancel. You authorise us to charge your Chosen Payment Method the subscription fee at the price then in effect for each renewal term, unless you cancel. You may cancel your subscription at any time by accessing the Subscriptions page in the App. To avoid being charged for the next renewal term, you must cancel at least 24 hours before the end of the current subscription period. Upon cancellation, you will receive a confirmation email or an in-app notification. Activated or partially used Package Passes are non-refundable, unless required by applicable law. If there are changes to the terms of your subscription, including prices, inclusions or renewal terms, we will notify you in advance as required by applicable law.

If you wish to withdraw from a Package Pass, you may (i) use the withdrawal form provided in Annex B, or (ii) make any other unequivocal statement setting out your decision to withdraw from a Package Pass by contacting us in accordance with clause 10.1.

We may issue coupons or promotional codes subject to the additional conditions established for that particular promotional code (the "Promotional Codes"). We reserve the right to modify or cancel Promotional Codes at any time at our sole and absolute discretion. We may suspend or cancel Promotional Codes and your use of the App at any time if we have reason to believe that the use or redemption of the Promotional Code was the result of an error induced by you, fraud, unlawful conduct, or a breach of the conditions applicable to the Promotional Codes or of this Agreement.
5.6. Nosotros podremos, a nuestra sola discreción y de manera no acumulada, imponerle las siguientes penalidades en función de si el Vehículo Eléctrico desbloqueado con su Cuenta:	5.6. We may, at our sole discretion and on a non-cumulative basis, impose the following penalties on you depending on whether the Electric Vehicle unlocked with your Account:

You agree that improper parking constitutes a breach of this Agreement and acknowledge that imposing the Parking Penalty is a reasonable and necessary measure to ensure the proper use of public parking areas, public spaces and the safety and comfort of other users and members of the public. By accepting these Terms of Service, you authorise us to charge your Chosen Payment Method an amount equivalent to the Parking Penalty.
5.7. Cuando utilice nuestros Servicios, deberá cumplir todas las disposiciones y normas aplicables a la circulación de Vehículos Eléctricos. Usted es responsable de cualquier multa, gastos de grúa, sanción, tasa de depósito del vehículo u otros cargos similares (conjuntamente, “Sanciones Municipales”) que resulten del uso de un Vehículo Eléctrico, del estacionamiento indebido del mismo o de cualquier infracción de leyes, normas, reglamentos u ordenanzas mientras haces uso de los Servicios.. Usted acepta que podamos revisar el fundamento de las Sanciones Municipales y las paguemos, ya sean emitidas directamente a Nosotros o en su nombre. Tenemos derecho a solicitar el reembolso de:	5.7. When using our Services, you must comply with all applicable provisions and rules relating to the operation of Electric Vehicles. You are responsible for any fine, towing cost, penalty, vehicle impound fee or other similar charge (together, the "Municipal Penalties") resulting from the use of an Electric Vehicle, from its improper parking, or from any breach of laws, rules, regulations or ordinances while using the Services. You agree that we may review the basis for the Municipal Penalties and pay them, whether issued directly to Us or on your behalf. We are entitled to seek reimbursement of:
5.7.1. El importe de la Sanción Municipal, en la moneda en la que haya sido emitida la sanción; más	5.7.1. The amount of the Municipal Penalty, in the currency in which the penalty was issued; plus

5.8. Al aceptar estos Términos de Servicio, nos autoriza a cargar en su Método de Pago Elegido un importe equivalente a cada Sanción Municipal o Sanción de Invitado, más una Tarifa Administrativa, sin necesidad de su intervención. Le notificaremos en el momento del cargo, o aproximadamente en ese momento, o con 14 días naturales de antelación si así lo exige la legislación aplicable. Si no está de acuerdo con la imposición o atribución de una Sanción Municipal, Sanción de Invitado o Tarifa Administrativa, o desea presentar una reclamación al respecto, debe ponerse en contacto con Nosotros de inmediato a través de los canales de contacto específicos del país indicados al principio de este Acuerdo o mediante nuestro equipo de atención al cliente a través del chat en la Aplicación.	5.8. By accepting these Terms of Service, you authorise us to charge your Chosen Payment Method an amount equivalent to each Municipal Penalty or Guest Penalty, plus an Administrative Fee, without any further action on your part. We will notify you at, or around, the time of the charge, or with 14 calendar days’ notice if required by applicable law. If you disagree with the imposition or attribution of a Municipal Penalty, Guest Penalty or Administrative Fee, or wish to submit a complaint about it, you must contact Us immediately through the country-specific contact channels indicated at the beginning of this Agreement or through our customer service team via the App’s chat function.
5.9. Todas las cantidades adeudadas y pagaderas a Nosotros se cargarán a su Método de Pago Elegido. Usted acepta que Bolt pueda generar y enviarle facturas o recibos detallando las tarifas y cargos por los servicios prestados en varios formatos, como por ejemplo por correo electrónico con un documento PDF adjunto, así como a través de la aplicación de Bolt, según lo exija la legislación aplicable. All amounts owed and payable to Us will be charged to your Chosen Payment Method. You agree that Bolt may generate and send you invoices or receipts detailing the fees and charges for the services provided, in various formats, such as by email with a PDF document attached, as well as through the Bolt app, as required by applicable law. Bolt will notify you of these charges; if these payment methods fail, other collection procedures may be used. You agree to reimburse all of our collection costs, including, without limitation, reasonable legal fees, if you fail to pay amounts owed to us when due. We are entitled to suspend, restrict or deactivate your Account if you fail to pay the amount owed to us when due. If you have any questions relating to the suspension, please contact our support team. Your Account will be reopened once you have paid the outstanding amount.
5.10. Puede pagar los Servicios con su Método de Pago Elegido, lo que requiere activación previa en la Aplicación. Usted nos autoriza a cargar al Método de Pago Elegido vinculado a su Cuenta todas las tarifas y cargos incurridos por Usted en virtud de este Acuerdo. You may pay for the Services using your Chosen Payment Method, which requires prior activation in the App. You authorise us to charge the Chosen Payment Method linked to your Account for all fees and charges incurred by you under this Agreement. These fees and charges may be subject to taxes, which will be withheld by Us. We may group several transactions together within a period of time, up to a maximum value that will depend on your location. Your Chosen Payment Method will be charged once the maximum value or time limit is reached. You may remove a Chosen Payment Method at any time, provided there are no failed payments. However, we may continue to use it to collect any outstanding cost, fine or debt generated before its removal.
5.11. Nosotros y nuestros contratistas aceptamos pagos en la Aplicación, damos asistencia y resolvemos disputas relacionadas con pagos en la Aplicación. We and our contractors accept payments in the App, provide support and resolve disputes relating to payments in the App. If you wish to dispute a transaction charged by Us to your Chosen Payment Method, you must contact Us in accordance with clause 10.1 within 10 working days.
5.12. En lo que respecta a pagos efectuados con tarjeta de crédito o débito, podremos cargar una comisión por servicio por cada uno de los pagos que se añade a cada pedido de Servicios. La comisión por servicio se aplica a Visa/Mastercard. El importe de la comisión por servicio se muestra en la Aplicación. Los proveedores de pago externos pueden cobrarle tarifas adicionales. Bolt no se hace responsable de estos cargos. Su banco podrá hacer cargos adicionales por el uso de su tarjeta de crédito o débito que no se reflejan en la Aplicación. Tenga en cuenta que después de haber reservado un Vehículo Eléctrico, preautorizamos automáticamente una cantidad de su tarjeta de crédito para confirmar la disponibilidad del pago.	5.12. In respect of payments made by credit or debit card, we may charge a service fee for each payment, which is added to each order for Services. The service fee applies to Visa/Mastercard. The amount of the service fee is shown in the App. External payment providers may charge you additional fees. Bolt is not responsible for such charges. Your bank may make additional charges for the use of your credit or debit card that are not reflected in the App. Please note that once you have booked an Electric Vehicle, we automatically pre-authorise an amount on your credit card to confirm payment availability.
5.13. Usted acepta notificarnos inmediatamente de cualquier cambio en el Método de Pago Elegido vinculado a su Cuenta que pueda impedir cobros en virtud del presente Acuerdo.	5.13. You agree to notify us immediately of any change to the Chosen Payment Method linked to your Account that may prevent charges under this Agreement.
5.14. Al realizar un pago utilizando el método de pago de Cuenta Bolt Business o Cuenta Familiar, la tarifa por los Servicios será pagada por la tercera persona que haya habilitado dicho método de pago para ti. En cuanto a todas las demás tarifas aplicables que no estén incluidas en la tarifa por el Servicio (daños, multas, sanciones, gastos de grúa, cargos y otras tarifas según lo establecido en el Acuerdo), tú y dicha tercera persona serán responsables solidarios, lo que significa que Bolt podrá cobrar dichas tarifas a ti, a la tercera persona o a ambos parcialmente. Dicha tercera persona tendrá los mismos derechos que tú en virtud del Acuerdo con respecto a los cargos relacionados con los Servicios: la factura o el recibo por los Servicios se emitirá a nombre de la tercera persona junto con cualquier reembolso (según corresponda), y dicha tercera persona podrá presentar reclamaciones y solicitar información relacionada con las tarifas cobradas y los Servicios utilizados bajo el método de pago de Cuenta Bolt Business o Cuenta Familiar.	5.14. When making a payment using the Bolt Business Account or Family Account payment method, the fee for the Services will be paid by the third party who enabled that payment method for you. As for all other applicable fees not included in the Service fee (damage, fines, penalties, towing costs, charges and other fees as set out in the Agreement), you and that third party will be jointly and severally liable, meaning that Bolt may charge such fees to you, to the third party, or partly to both. That third party will have the same rights as you under the Agreement with respect to charges related to the Services: the invoice or receipt for the Services will be issued in the name of the third party, together with any refund (as applicable), and that third party may submit claims and request information relating to the fees charged and the Services used under the Bolt Business Account or Family Account payment method.
6. Responsabilidad	6. Liability
6.1. Usted reconoce y acepta que su uso de los Servicios, Vehículos Eléctricos y del equipo que forme parte del mismo será exclusivamente de su propia responsabilidad, y que Nosotros no asumiremos ninguna responsabilidad por las posibles consecuencias, reclamaciones, demandas, causas de acción, pérdidas, responsabilidades, daños, lesiones, honorarios, costes y gastos, sanciones, honorarios legales o desembolsos de cualquier tipo, bien sean predecibles o no, conocidos o desconocidos, que Usted o un tercero pudiese sufrir como resultado de su uso directo de los Servicios y los Vehículos Eléctricos. Sin perjuicio de lo anterior, Nuestra responsabilidad por aquellos daños directamente imputables a Nosotros contra personas físicas, defunción y daños contra la propiedad se ajustará a lo dispuesto en la normativa aplicable en el Área de Servicio y, en particular, a las disposiciones del Código Civil Español en materia de responsabilidad.	6.1. You acknowledge and agree that your use of the Services, the Electric Vehicles and any equipment forming part thereof shall be entirely at your own risk and responsibility, and that We shall not assume any liability for any possible consequences, claims, demands, causes of action, losses, liabilities, damages, injuries, fees, costs and expenses, penalties, legal fees or disbursements of any kind, whether foreseeable or not, known or unknown, that you or a third party may suffer as a result of your direct use of the Services and the Electric Vehicles. Notwithstanding the foregoing, Our liability for damage directly attributable to Us against natural persons, death and damage to property shall be governed by the applicable regulations in the Service Area and, in particular, by the provisions of the Spanish Civil Code on liability.
6.2. Usted comprende completamente dichos riesgos y reconoce que:	6.2. You fully understand these risks and acknowledge that:
6.2.1. la conducción del Vehículo Eléctrico implica varios riesgos y peligros obvios y no tan obvios, que pueden causarle a Usted o a terceros lesiones o muerte, así como daños a la propiedad, y que dichos riesgos y peligros no siempre pueden predecirse o evitarse. Tales riesgos incluyen, pero no se limitan a:	6.2.1. driving the Electric Vehicle involves various obvious and not-so-obvious risks and hazards, which may cause you or third parties injury or death, as well as damage to property, and that such risks and hazards cannot always be predicted or avoided. Such risks include, but are not limited to:
● Colisiones con peatones, vehículos y otros objetos;	● Collisions with pedestrians, vehicles and other objects;
● Condiciones de la vía, incluyendo baches o pavimento agrietado; Condiciones climáticas que puedan afectar el uso seguro del Vehículo Eléctrico;	● Road conditions, including potholes or cracked pavement; Weather conditions that may affect the safe use of the Electric Vehicle;
● Tráfico; y	● Traffic; and
● Reducciones automáticas de velocidad en zonas de “prohibido circular” o “baja velocidad” designadas por las autoridades locales.	● Automatic speed reductions in "no-riding" or "low-speed" zones designated by local authorities.

6.3. Si su uso de cualquiera de los Servicios causa lesiones o daños a otra persona o propiedad por su conducta directa, Usted será responsable de todas y cada una de las consecuencias, reclamos, demandas, litigios, pérdidas, responsabilidades, daños, lesiones, honorarios, costos y gastos, sanciones, honorarios legales, sentencias, juicios o desembolsos de cualquier tipo, ya sean previsibles o imprevisibles y conocidos o desconocidos. Si, por causa directamente imputable a su conducta, nosotros debemos pagar por reclamaciones de terceros, Usted es el único responsable ante Nosotros y acepta compensarnos todas las pérdidas en que hayamos incurrido al pagar dichas reclamaciones de terceros.	6.3. If your use of any of the Services causes injury or damage to another person or property through your direct conduct, you will be liable for any and all consequences, claims, demands, lawsuits, losses, liabilities, damages, injuries, fees, costs and expenses, penalties, legal fees, judgments, verdicts or disbursements of any kind, whether foreseeable or unforeseeable and known or unknown. If, as a result of a cause directly attributable to your conduct, we must pay third-party claims, you shall be solely liable to Us and agree to reimburse us for all losses we have incurred in paying such third-party claims.
6.4. Si, por cualquier razón, Usted no es elegible para la Cobertura de Seguro, Usted entiende y acepta que Usted asumirá cualquier costo que cause a terceros, incluyendo, entre otros, costes de servicio de transporte en ambulancia, estadía en hospital y tratamiento médico.	6.4. We reserve the right to offer liability insurance (the "Insurance Coverage") to cover, subject to the limitations and exceptions of the Insurance Coverage, liability that you incur with respect to injury to third parties or accidental damage to the physical property of a third party as a result of your use of the Electric Vehicle. If, for any reason, you are not eligible for the Insurance Coverage, you understand and agree that you will bear any cost you cause to third parties, including, without limitation, ambulance transport, hospital stay and medical treatment costs.
6.5. Todos los servicios, en particular los Vehículos Eléctricos y el equipo relacionado, se proporcionan "TAL CUAL" y "SEGÚN DISPONIBILIDAD". All services, in particular the Electric Vehicles and related equipment, are provided "AS IS" and "AS AVAILABLE". To the extent permitted by law, we exclude and disclaim any warranty or condition of any kind, whether express, implied or imposed by any applicable law. We do not represent or warrant that any of the Services, Electric Vehicles or related equipment are in good condition or fault-free, or that there will be no delays, omissions, interruptions or inaccuracies in relation to any of the Services, Electric Vehicles or related equipment. In particular, we make no representation, warranty, endorsement or promise, whether express or implied, with respect to:
6.5.1. la reparación o corrección de posibles defectos o errores de los Servicios;	6.5.1. the repair or correction of possible defects or errors in the Services;
6.5.2. la disponibilidad de los Servicios en un momento o Área de Servicio determinados; y	6.5.2. the availability of the Services at a given time or in a given Service Area; and
6.6. Toda condición y garantía implícita de cualquier tipo en relación con los Servicios se excluye en la medida máxima permitida por la ley. Lo dispuesto en este Acuerdo no excluye, restringe o modifica ninguna garantía, término o condición, derecho o remedio implícito o impuesto por la legislación aplicable que no pueda excluirse, restringirse o modificarse al amparo de la legislación.	6.6. Any implied warranty or condition of any kind relating to the Services is excluded to the maximum extent permitted by law. Nothing in this Agreement excludes, restricts or modifies any warranty, term, condition, right or remedy implied or imposed by applicable law that cannot be excluded, restricted or modified under that law.
6.7. 6.8. En ningún caso, Nuestra responsabilidad conjunta máxima por cualquiera de las reclamaciones que surgiesen del presente Acuerdo, incluyendo basadas en agravios u otros motivos, excederá 500 € o el importe pagado a Nosotros por el periodo de alquiler durante el cual ocurrió el incidente, accidente o hecho causa de la reclamación, según cuál sea el menor. Sin embargo, Nosotros no limitamos su derecho a reclamar los daños o a solicitar cualquier otra indemnización prevista por la ley aplicable en caso de incumplimiento de nuestros Servicios con estos Términos de Servicio, o daños directos en aquellas materias sobre las cuales la responsabilidad no pudiera ser limitada de conformidad con la ley aplicable.	6.8. In no event shall Our aggregate maximum liability for any claims arising out of this Agreement, whether based on tort or other grounds, exceed EUR 500 or the amount paid to Us for the rental period during which the incident, accident or event giving rise to the claim occurred, whichever is lower. However, We do not limit your right to claim damages or seek any other remedy provided for by applicable law in the event of a breach by our Services of these Terms of Service, or for direct damages in matters where liability cannot be limited under applicable law.
6.9. Ni Nosotros ni Usted seremos responsables por los daños, retrasos o fallas de funcionamiento debidos a circunstancias fuera del control razonable de la parte incumplidora, incluyendo, entre otros, hechos debidos a desastres naturales o fuerza mayor, terremotos, incendios, inundaciones, guerras, terrorismo, desórdenes civiles, industriales o militares, sabotaje, huelgas o cierres patronales, pandemias, epidemias, protestas, pérdida o mal funcionamiento de las instalaciones o servicios de comunicación, ciberataques, autos judiciales, actos de una autoridad civil o militar o acciones gubernamentales, judiciales o regulatorias.	6.9. Neither We nor You will be liable for damages, delays or failures resulting from circumstances beyond the reasonable control of the defaulting party, including, without limitation, events due to natural disasters or force majeure, earthquakes, fires, floods, wars, terrorism, civil, industrial or military unrest, sabotage, strikes or lockouts, pandemics, epidemics, protests, loss or malfunction of facilities or communication services, cyberattacks, court orders, acts of a civil or military authority, or governmental, judicial or regulatory actions.
6.10. En la medida máxima permitida por la legislación aplicable, ni Nosotros ni Nuestras filiales, representantes, administradores o empleados asumiremos responsabilidad alguna por pérdidas o daños que Usted sufra en virtud de, o en relación con, el presente Acuerdo o como consecuencia del uso de la Aplicación, como, por ejemplo:	6.10. To the maximum extent permitted by applicable law, neither We nor Our affiliates, representatives, directors or employees will assume any liability for losses or damages you suffer under, or in connection with, this Agreement or as a result of using the App, such as, for example:

7.1. Usted confirma que cualquier texto, imágenes u otra información que Usted Nos facilite durante el uso de los Servicios (”Su Contenido”) cumplirá con la Normativa de Uso Aceptable descrita en la Sección 8.	7.1. You confirm that any text, images or other information that you provide to Us during your use of the Services (the "Your Content") will comply with the Acceptable Use Policy described in Section 8.
7.2. No nos hacemos titulares de Su Contenido y Usted y cualquier tercero, cuyo contenido Usted haya incluido en Su Contenido, seguirán siendo los titulares de este contenido. Usted nos otorga una licencia mundial, no exclusiva, libre de regalías y perpetua, para usar, copiar, reproducir, distribuir, adaptar, reformatear, modificar, publicar, comercializar, anunciar, traducir, licenciar, sublicenciar y explotar Su Contenido en cualquier lugar y en cualquier forma, con el fin de proporcionar los Servicios (incluido, donde proceda, permitir que otros usuarios vean Su Contenido).	7.2. We do not become the owner of Your Content, and you and any third party whose content you have included in Your Content will remain the owner of such content. You grant us a worldwide, non-exclusive, royalty-free and perpetual licence to use, copy, reproduce, distribute, adapt, reformat, modify, publish, market, advertise, translate, licence, sublicence and exploit Your Content anywhere and in any form, for the purpose of providing the Services (including, where applicable, allowing other users to view Your Content).
7.3. Usted deberá garantizar que puede concedernos la licencia mencionada sobre cualquier contenido de propiedad de terceros que Usted incluya en Su Contenido.	7.3. You must ensure that you are able to grant us the aforementioned licence over any third-party-owned content that you include in Your Content.

In addition to the other requirements set out in this Agreement, this section describes the specific rules that apply to your use of the App (the "Acceptable Use Policy").

8.2.1. evadir, deshabilitar o interferir de cualquier otro modo con las funciones de seguridad de la Aplicación;	8.2.1. evade, disable or otherwise interfere with the App’s security features;
8.2.2. permitir que otra persona use la Aplicación en su nombre;	8.2.2. allow another person to use the App on your behalf;
8.2.3. usar la Aplicación si le hemos suspendido o le hemos prohibido usarla;	8.2.3. use the App if we have suspended you or prohibited you from using it;
8.2.4. defender, promover o participar en actos ilegales o ilícitos o cualquier acto que pueda causar daños o lesiones a terceros o a la propiedad;	8.2.4. advocate, promote or engage in unlawful or illicit acts, or any act that may cause harm or injury to third parties or property;
8.2.5. modificar, interferir, interceptar, alterar o hackear la Aplicación;	8.2.5. modify, interfere with, intercept, tamper with or hack the App;
8.2.6. usar la Aplicación indebidamente introduciendo intencionalmente virus, troyanos, gusanos, bombas lógicas u otro material que pueda perjudicar la Aplicación o a sus usuarios;	8.2.6. misuse the App by intentionally introducing viruses, trojans, worms, logic bombs or other material that may harm the App or its users;
8.2.7. recopilar cualquier información de la Aplicación no conforme a este Acuerdo;	8.2.7. collect any information from the App not in accordance with this Agreement;
8.2.8. enviar o publicar ningún Contenido suyo que incluya desnudos, violencia o sea abusivo, amenazante, obsceno, engañoso, falso u ofensivo;	8.2.8. send or post any of Your Content that includes nudity, violence, or that is abusive, threatening, obscene, misleading, false or offensive;
8.2.9. enviar o publicar ningún Contenido suyo, del que no sea titular o sobre el que no tenga derecho de uso o que de otra manera infrinja los derechos de propiedad intelectual e industrial u otros derechos de terceros;	8.2.9. send or post any of Your Content that you do not own or have the right to use, or that otherwise infringes the intellectual or industrial property rights or other rights of third parties;
8.2.10. usar Su Contenido violando las condiciones de licencia especificadas por el propietario de este;	8.2.10. use Your Content in breach of the licence conditions specified by its owner;
8.2.11. enviar o publicar información o comentarios acerca de terceros sin el permiso de esas personas;	8.2.11. send or post information or comments about third parties without their permission;
8.2.12. amenazar, abusar o invadir la privacidad de otra persona, o causar molestias, inconvenientes o ansiedad innecesaria o acosar, enfadar, avergonzar, alarmar o molestar a cualquier otra persona;	8.2.12. threaten, abuse or invade another person’s privacy, or cause unnecessary annoyance, inconvenience or anxiety, or harass, anger, embarrass, alarm or upset any other person;
8.2.13. usar sistemas automáticos, incluyendo, entre otros, 'robots', 'arañas' o 'lectores sin conexión' para acceder a la Aplicación enviando más solicitudes de lo que un humano puede enviar razonablemente durante el mismo tiempo; o	8.2.13. use automated systems, including, without limitation, ‘robots’, ‘spiders’ or ‘offline readers’ to access the App by sending more requests than a human could reasonably send during the same period of time; or
8.2.14. ejecutar otra acción considerada inapropiada para el uso de la Aplicación.	8.2.14. carry out any other action deemed inappropriate for use of the App.
8.3. El incumplimiento de la Normativa de Uso Aceptable, las Normas Generales de Conducción o las Herramientas de Seguridad, constituye una violación sustancial de este Acuerdo y puede conducir a:	8.3. Failure to comply with the Acceptable Use Policy, the General Driving Rules or the Safety Tools constitutes a material breach of this Agreement and may lead to:
8.3.1. la suspensión inmediata, temporal o permanente, de su derecho al uso de la Aplicación y/o de cualquier aplicación o servicio Nuestro;	8.3.1. the immediate, temporary or permanent suspension of your right to use the App and/or any of Our other applications or services;
8.3.2. la eliminación inmediata, temporal o permanente, de cualquier parte de Su Contenido;	8.3.2. the immediate, temporary or permanent removal of any part of Your Content;
8.3.3. un aviso;	8.3.3. a warning;
8.3.4. acciones legales contra Usted, incluyendo procedimientos para el reembolso de todos los costes (incluyendo, entre otros, gastos administrativos y legales razonables) que resulten de tal incumplimiento; y	8.3.4. legal action against you, including proceedings for reimbursement of all costs (including, without limitation, reasonable administrative and legal expenses) resulting from such breach; and
8.3.5. la divulgación de dicha información a las autoridades policiales, según lo consideremos razonablemente necesario.	8.3.5. disclosure of such information to law enforcement authorities, as we reasonably consider necessary.
9. Legislación Aplicable	9. Applicable Law
9.1. El presente Acuerdo se regirá e interpretará según las leyes de la República de Estonia o, en caso de que Usted sea un consumidor y usuario de conformidad con la normativa aplicable, el presente Acuerdo se interpretará conforme a la normativa del país de su residencia.	9.1. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Estonia or, where you are a consumer and user under applicable regulations, this Agreement shall be construed in accordance with the law of your country of residence.
9.2. Sus obligaciones pueden regirse por las leyes del Área de Servicio, por ejemplo, las leyes y reglamentos de tráfico y estacionamiento aplicables en el Área de servicio ("Legislación Local") y Usted acepta cumplir con esta Legislación Local.	9.2. Your obligations may be governed by the laws of the Service Area, for example, the traffic and parking laws and regulations applicable in the Service Area (the "Local Legislation"), and you agree to comply with this Local Legislation.
9.3. Si Usted es un consumidor y tiene su residencia habitual en la UE, Usted además disfruta de la protección que le brindan las disposiciones mandatorias de su país de residencia. Tanto Usted como Nosotros nos sometemos a la jurisdicción no exclusiva de los tribunales de Estonia, lo que significa que Usted puede presentar una reclamación para hacer valer sus derechos de protección del consumidor en relación con este Acuerdo en Estonia o en el país de la UE en el que vive.	9.3. If you are a consumer and habitually reside in the EU, you also benefit from the protection afforded by the mandatory provisions of your country of residence. Both you and We submit to the non-exclusive jurisdiction of the courts of Estonia, meaning that you may bring a claim to enforce your consumer protection rights in connection with this Agreement in Estonia or in the EU country in which you live.
10. Varios	10. Miscellaneous
10.1. Las notificaciones y otra comunicación relacionadas con el presente Acuerdo o con los Servicios se efectuarán a través de la Aplicación, por correo electrónico a madrid o mediante los canales de atención al cliente disponibles en Nuestra Aplicación o página web.	10.1. Notices and other communications relating to this Agreement or the Services will be made through the App, by email to [email protected], or through the customer service channels available in Our App or website.
10.2. Usted acepta que este Acuerdo y todos los acuerdos incorporados pueden ser asignados automáticamente por Nosotros a nuestra sola discreción. En la medida en que dicha cesión pueda suponer una modificación en las condiciones y términos del tratamiento de datos personales de su titularidad, Usted será notificado con la debida antelación a dicha circunstancia.	10.2. You agree that this Agreement and all incorporated agreements may be automatically assigned by Us at our sole discretion. To the extent that such assignment may result in a modification of the terms and conditions governing the processing of your personal data, you will be notified with due advance notice of such circumstance.

1 Controles de Seguridad	1 Safety Checks
1.1 Es su responsabilidad realizar un control diligente de seguridad antes de usar el Vehículo Eléctrico, el que debe incluir, entre otras cosas, lo siguiente:	1.1 It is your responsibility to carry out a diligent safety check before using the Electric Vehicle, which must include, among other things, the following:
(a) el buen estado del bastidor;	(a) the good condition of the frame;
(b) el buen estado de las llantas (es decir, que haya suficiente presión en los neumáticos y que no estén obstruidos por basura o lodo);	(b) the good condition of the tyres (i.e., that there is sufficient tyre pressure and that they are not obstructed by debris or mud);
(c) la operación segura de los frenos; (d) que la batería tenga carga suficiente;	(c) the safe operation of the brakes; (d) that the battery has sufficient charge;

(g) que el Vehículo Eléctrico no presente señales de daños, desgaste inusual o excesivo u otro problema mecánico o que precise mantenimiento;	(g) that the Electric Vehicle shows no signs of damage, unusual or excessive wear, or any other mechanical problem or need for maintenance;
(h) siga las instrucciones, en particular, las Herramientas de Seguridad, que se le proporcionan en la Aplicación al momento de reservar el Vehículo Eléctrico.	(h) follow the instructions, in particular the Safety Tools, provided to you in the App when booking the Electric Vehicle.
1.2 Durante el viaje, Usted deberá vigilar constantemente que, tanto el Vehículo Eléctrico como su funcionamiento, cumplan con los requisitos de seguridad antes mencionados. En caso de que, durante el viaje, Usted detecte incumplimiento de los requisitos de seguridad u otro defecto, problema o amenaza que potencialmente disminuya su seguridad, deberá detener el Vehículo Eléctrico inmediatamente -cuando sea seguro hacerlo- y notificarnos de dicha situación, de conformidad con lo dispuesto en el apartado 10.1 del presente Acuerdo.	1.2 During the trip, you must constantly monitor that both the Electric Vehicle and its operation meet the above safety requirements. If, during the trip, you detect a failure to meet the safety requirements or another defect, problem or threat that could potentially reduce your safety, you must stop the Electric Vehicle immediately – when it is safe to do so – and notify us of the situation, in accordance with clause 10.1 of this Agreement.
2 Seguridad Vial	2 Road Safety
2.1 Usted deberá conducir y operar el Vehículo Eléctrico de forma segura en todo momento. Al usar, conducir u operar el Vehículo Eléctrico, Usted:	2.1 You must drive and operate the Electric Vehicle safely at all times. When using, driving or operating the Electric Vehicle, you:
(a) debe cumplir con todas las leyes y regulaciones de tráfico aplicables;	(a) must comply with all applicable traffic laws and regulations;
(b) debe seguir las instrucciones de las Herramientas de Seguridad;	(b) must follow the instructions of the Safety Tools;
(c) debe usar el equipo de seguridad de la manera recomendada y según lo requerido por las leyes, reglamentos e instrucciones mencionados, y que son razonablemente necesarios para disminuir el riesgo de lesiones personales (tales como casco, almohadillas protectoras y calzado adecuado);	(c) must use safety equipment as recommended and as required by the aforementioned laws, regulations and instructions, and which are reasonably necessary to reduce the risk of personal injury (such as a helmet, protective pads and suitable footwear);
(d) no debe conducir el Vehículo Eléctrico bajo la influencia del alcohol, drogas, medicamentos u otras sustancias que puedan afectar su capacidad para operar el Vehículo Eléctrico de manera segura;	(d) must not drive the Electric Vehicle under the influence of alcohol, drugs, medication or other substances that may affect your ability to operate the Electric Vehicle safely;
(e) debe observar el límite de velocidad y adaptar la velocidad según la situación, teniendo en cuenta su experiencia de conducción, las condiciones de la vía, el estado de la vía y del Vehículo Eléctrico, las condiciones climáticas, la densidad del tráfico y otras condiciones de tráfico, de modo que pueda detener el Vehículo Eléctrico sin chocar contra ningún obstáculo que esté o sea razonable que esté en la vía;	(e) must observe the speed limit and adapt speed to the situation, taking into account your driving experience, road conditions, the condition of the road and of the Electric Vehicle, weather conditions, traffic density and other traffic conditions, so as to be able to stop the Electric Vehicle without colliding with any obstacle that is, or could reasonably be, on the road;
(f) no debe usar teléfonos móviles, tabletas, ordenadores portátiles, dispositivos de mensajería de texto, reproductores de música u otro dispositivo que pueda distraer su atención de la conducción segura del Vehículo Eléctrico;	(f) must not use mobile phones, tablets, laptops, text messaging devices, music players or any other device that may distract your attention from safely driving the Electric Vehicle;

(n) no debe exceder el límite de carga (95 kg) del Vehículo Eléctrico;	(n) must not exceed the Electric Vehicle’s load limit (95 kg);
(o) no debe llevar pasajeros extras;	(o) must not carry extra passengers;
(p) no debe llevar ningún artículo (como maletines, mochilas, bolsas y/u otros artículos) que pueda impedir la operación segura del Vehículo Eléctrico; y	(p) must not carry any item (such as briefcases, backpacks, bags and/or other items) that could hinder the safe operation of the Electric Vehicle; and
(q) debe usar ropa de colores claros para asegurarse de que otros usuarios de la vía pública puedan notarlo fácilmente.	(q) must wear light-coloured clothing to ensure that other road users can easily notice you.
3 Aparcamiento	3 Parking
3.1 Usted:	3.1 You:
(a) no debe estacionar el Vehículo Eléctrico de manera que contravenga la Legislación Local aplicable;	(a) must not park the Electric Vehicle in a manner that contravenes the applicable Local Legislation;
(b) no debe obstruir la vía, impedir el tráfico ni alterar el orden de las aceras;	(b) must not obstruct the road, impede traffic or disrupt the order of pavements;
(c) debe estacionar el Vehículo Eléctrico visiblemente y de pie de manera que otros usuarios también puedan disfrutar del Vehículo Eléctrico;	(c) must park the Electric Vehicle visibly and upright so that other users can also enjoy the Electric Vehicle;
(d) debe seguir las instrucciones de estacionamiento de la Aplicación y, en su caso, estacione el Vehículo Eléctrico en el Área de Aparcamiento Permitida designada;	(d) must follow the App’s parking instructions and, where applicable, park the Electric Vehicle in the designated Permitted Parking Area;
(e) mientras usa los Servicios, debe informarnos de todo Vehículo Eléctrico no estacionado en un Área de Aparcamiento Permitida, notificándonos de conformidad con el apartado 10.1 o usando la función correspondiente de la Aplicación.	(e) while using the Services, must inform us of any Electric Vehicle not parked in a Permitted Parking Area, by notifying us in accordance with clause 10.1 or using the corresponding function in the App.
(f) tomar una fotografía clara de todo el Vehículo Eléctrico al final del trayecto cuando se le solicite en la Aplicación.	(f) take a clear photograph of the entire Electric Vehicle at the end of the trip when requested to do so in the App.
4 Normas específicas del área de servicio de Barcelona	4 Specific rules for the Barcelona service area
4.1 Usted:	4.1 You:
(a) debe ser mayor de 18 años para usar los Servicios;	(a) must be over 18 years of age to use the Services;
(b) debe comenzar y terminar su viaje en los lugares de estacionamiento designados en Nuestra Aplicación.	(b) must start and end your trip at the parking locations designated in Our App.
4.2 Está prohibido el estacionamiento de bicicletas eléctricas en cualquier punto de la ciudad que no sea un lugar de estacionamiento municipal específico y no estará permitido en Nuestra Aplicación, pudiendo resultar en una multa a pagar por el Conductor.	4.2 Parking electric bicycles anywhere in the city other than a specific municipal parking location is prohibited and will not be permitted in Our App, and may result in a fine payable by the Driver.
