Marketing Campaign Terms and Conditions for Boss Emotion Club London E Prix
Effective from: 25 July 2023
These Marketing Campaign Terms and Conditions (“MTCs”) are intended to govern participation in the Bolt giveaway for Boss Emotion Club London E Prix. (hereinafter referred to as the “Campaign”).
Participation in the Campaign is subject to these MTCs and supplemented by our Additional Terms (as referenced below in the definitions and linked accordingly). By participating in the Campaign, Participants accept that these terms and conditions are legally binding.
1. Definitions
Within the scope of these MTCs, the following definitions will apply:
Additional Terms – refers to the General Terms and Conditions for Passengers here, in addition to the Privacy Policy here.
Bolt - refers to Bolt Services UK Limited (also referred to as we, ours or us) - Bolt Services UK Limited is a registered company under the laws of England, company number: 11063356.
Bolt Platform – refers to the Bolt App and any additional software utilised by Bolt for the provision of rideshare services.
Campaign - refers to the Bolt Boss Emotion Club London E Prix Campaign.
Campaign Term - means 12:00 am on 25 July 2023 to 11:59 am on 28 July 2023.
Draw Date - means 28 July 2023.
MTCs - means the Marketing Campaign Terms and Conditions referred to in this document.
Participant – means an eligible person referred to in clause 3.
Prize - means two tickets to Boss Emotion London Grand Prix on 29th July 2023 (the two tickets to Boss Emotion London Grand Prix are provided by Allianz) and £100 in total of Bolt promo ride credit that must be used within one month of the Draw Date.
Winner - also collectively referred to as Winners, means the Participant who has been selected for the Prize Draw.
2. The Campaign
2.1. This Campaign is only available to Participants in England and Wales.
2.2. Only natural persons with full legal capacity can enrol in the Campaign.
2.3. If you have any questions about this Campaign or these MTCs, contact us at (@london@bolt.eu).
2.4. Bolt employees and companies belonging to the same group as Bolt as well as their family members are not eligible to participate in this Campaign.
2.5. It is not possible for a single Participant to win the Prize multiple times.
3. How to Enter the Campaign
3.1. Participants who meet the eligibility criteria described below will be included in this Campaign and shall be considered a Participant at the absolute discretion of Bolt.
3.2. Participants must:
3.2.1. Follow @bolt_uk on social media platform Instagram;
3.2.2. View Bolts post for this Campaign and tag one friend in the comments section. The friend you tag will be the friend you would like to bring to the Prize;
3.2.3. Participants are not required to be signed up to the Bolt Platform, however by participating in this Campaign, Participants consent to having their name published on Bolts websites, client communications, emails and other social media channels;
3.2.4. Only one entry per Participant is considered;
3.2.5. ensure their entry into the Campaign is completed before 12.00 pm on 28 July 2023;
3.2.6. comply with these MTC’s as well as Bolts Additional Terms; and
3.2.7. comply with all relevant applicable laws in England and Wales.
3.3. Bolt reserves the right to refuse participation in the Campaign to:
3.3.1. any Participant who does not comply with these MTCs or our Additional Terms;
3.3.2. any Participant who has previously violated our Additional Terms;
3.3.3. any Participant who engages in fraudulent activity or gives rise to suspicion of fraudulent activity;
3.3.4. any Participant whose conduct is contrary to the spirit or intent of the Campaign; and
3.3.5. any Participant that hasn’t been selected for the purpose of this Campaign.
4. Prize and Draw Date
4.1. A Participant will be included in this Campaign in accordance with clause 3.
4.2. All entries are subject to compliance with the entry criteria contained within these MTCs.
4.3. The Prize cannot be exchanged or transferred for any other alternative Prize or any monetary value.
4.4. The Prize is at Bolt’s sole discretion, Bolt retains the right to change the Prize at any time during the Campaign.
5. Winners
5.1. During the Campaign, there will be one Winner in total selected.
6. Prize Draws
6.1. During the Campaign Term a Participant has a maximum of one entry.
6.2. All entries are subject to compliance with the entry criteria.
6.3. The Winner will be selected randomly by Bolt via a computerised random selection process on or shortly after the Draw Date.
6.4. Winners will be notified via instagram direct message that they have won, we aim to notify the Winners as soon as reasonably possible after the Draw Date. Winners are required to provide their contact details and email address, we will send the Prize to the email address provided. It is your responsibility as a Participant to make sure the contact details you provide via Instagram direct message are up-to-date.The name of the Winners will be published on Bolt’s blog, Bolt’s website, in client communications, e-mails and/or social media channels.
6.5. The Winner has 24 hours to accept the Prize. If the Prize is rejected, or if the Winner is subsequently found to be ineligible for a Prize, they will be disqualified, and the next Participant who meets the criteria will be selected randomly.
6.6. Bolt’s decisions regarding any aspect of the prize draws are final and binding.
7. Privacy
7.1. In the Campaign, Bolt processes data of the Participant in order to fulfil the conditions of the Campaign, to comply with its legal obligations and to pursue its legitimate interests, pursuant to Article 6 (1) (c) and (f) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). The processing of personal data is necessary in order to announce the name of the Participant and for the purpose of awarding the Prize. Bolt is a data controller of Participant’s personal data.
7.2. The data is provided to Bolt voluntarily, but failing to do so may lead to Bolt not being able to contact the winner of the Campaign. Bolt may transfer personal data to an authorised processor, who will draw Prizes. If the campaign is run on a social media platform (such as, but not limited to Facebook, Instagram, TikTok) Bolt Participants will process their social media profile and social media activity (posting, liking, commenting). Bolt may also share Participant’s data with other entities within Bolt group, providers of online cloud storage services and other essential IT services and providers of marketing services. Bolt may also be obliged to share Participant’s personal data with public authorities authorised to process personal data. Where Bolt shares data with its suppliers located outside of the EU or EEA, such transfer of personal data will take place only upon appropriate legal basis, and Bolt will take appropriate protective measures such as standard contractual clauses or the adequacy decision issued by the European Commission.
7.3. The data is acquired directly from the Participant and via additional tooling or applications used to conduct the Campaign such as Boss Emotion Club London E Prix.
7.4. The Participant has a right to request access to and rectification or erasure of personal data or restriction of processing of personal data or to object to processing as well as the right to data portability. Where a Participant's data is processed on the basis of a consent, the Participant has a right to withdraw it at any time, without affecting the lawfulness of processing based on consent before its withdrawal. In case of any unresolved privacy concerns, the Participant has the right to complain to a data protection authority.
7.5. For any queries related to Bolt’s processing practices, the Participant may contact Bolt by post at Bolt Operations OÜ, Vana-Lõuna tn 15, Tallinn 10135. The Participant may contact Bolt’s Data Protection Officer electronically at privacy@bolt.eu.
7.6. The personal data of the Participant will be kept until the winner is presented with the Prize. After the Prize is presented to the winner, Bolt will only retain the winner's first and last name for one year for use in the media, advertising and other Bolt-related events, as appropriate and where required- for the purposes of complying with legal obligations for the duration of statutory retention periods.
7.7. Should the Participant be using third person’s personal data while participating in the Campaign (for example, but not limited to, posting a photo of a third party) then this Participant has to obtain a clear acceptance from this third party to use third person’s personal data for the purposes of this Campaign.
8. General Conditions
8.1. The Campaign will be run by Bolt who will be responsible for determining the Winner and fulfilling the Prize. Bolt will not be liable for any claims relating to this Campaign nor for any liability, direct or indirect, special or consequential, arising in any way from the Campaign.
8.2. Formula E is not affiliated with the promotion in any way. Formula E will not be liable for any claims relating to this Campaign nor for any liability, direct or indirect, special or consequential, arising in any way from the Campaign or the Campaign Prize.
8.3. The interpretation of these MTCs and Additional Terms rests exclusively with Bolt, which reserves the right to change such terms from time to time.
8.4. Bolt further reserves the right to change, limit or terminate the Campaign in its sole discretion.
8.5. As far as it is permitted by law, Bolt, its agents or distributors will not in any circumstances be responsible or liable to compensate the Participant or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of Bolt, its agents or distributors or that of their employees. In particular, Bolt will not be liable for any obligation you have in respect of any events beyond its reasonable control, any tax implications or liabilities of any Participants Prize.
8.6. Any Participant who participates in the Campaign will be deemed to have accepted and agreed to be bound by these MTCs and Additional Terms upon entry into the Campaign or if the Participant takes the benefit of accepting the Prize the Winners agree to comply with Formula E Operations Limited’s (‘Formula E’) hospitality T&Cs, found here.
8.7. Bolt reserves the right to refuse entry, or refuse to give the Prize to anyone in breach of these MTCs and Additional Terms.
8.8. Bolt reserves the right to hold void, cancel, suspend, or amend the Prize if it becomes necessary to do so.
8.9. The Prize will be governed by the law of England and Participants to the Campaign submit to the exclusive jurisdiction of the courts of England and Wales.
8.10. The Participant will not display or transmit any material (either directly or indirectly, for example through a referral link or any other media) that:
8.10.1. is inappropriate, unethical, threatening, abusive or invasive of another’s privacy, or causes annoyance, inconvenience or needless anxiety;
8.10.2. is likely to harass, upset, embarrass, alarm or annoy any other person;
8.10.3. impersonates any person, or misrepresents Participants identity or affiliation with any person;
8.10.4. gives the impression that such material emanates from Bolt unless specifically given to Participant by Bolt for that purpose; or
8.10.5. is detrimental to Bolt’s reputation.
9. Applicable legislation and resolution
9.1. In the event that any of the provisions of these MTCs are found to be totally or partially ineffective, this decision will not affect the validity of the remaining parts of these MTCs and Additional Terms.
9.2. These MTCs will be governed by and interpreted in accordance with laws of England and the parties submit to the non-exclusive jurisdictional competence of the courts of England and Wales.
9.3. Any dispute that may arise in relation to these MTCs, Additional Terms and the Campaign, whether concerning their existence, validity, interpretation, performance, breach, termination or other matters, shall be resolved through negotiations. If any dispute resulting from these MTCs, Additional Terms and the Campaign cannot be resolved through negotiation, the dispute must be resolved in the courts of England and Wales.
