Bolt Spring Driver Of The Month Programme - Special Terms and Conditions

These Special Terms and Conditions (“STCs”) are intended to govern participation in the “Bolt Spring Driver of the Month” contest (hereinafter referred to as the “Programme” and further described below) promoted by Bolt for the participation of their Drivers (the “Participants”).

Participation in the Programme is subject to these STCs and supplemented by our Additional Terms (as referenced below in the definitions and linked accordingly). By participating in the Programme, Participants accept that these terms and conditions are legally binding.

1. The Programme

This Programme is only available in the United Kingdom and will run from 12:00 am on the 1st April 2023 to 11:59 pm on 30th June 2023 (the “Programme period”). During this Programme Period, Drivers are encouraged to increase their number of orders completed on the Bolt Platform. Eligibility for the Programme is outlined in clause 3 of these STCs.

2. Definitions

Within the scope of these STCs, the following definitions will apply.

Additional Terms – refers to the General Terms and Conditions for Fleet Partners/Drivers and the Privacy Policy (all available here) in addition to the Marketing General Terms and Conditions for Drivers available here.

Bolt – refers to Bolt UK Services Limited (also referred to as we, ours or us) - Bolt UK Services Limited is a registered company under the laws of England and Wales, company number: 11063356, registered address: Studio 4 114 Power Road, London, W4 5PY.

Bolt Platform – refers to the Bolt App and any additional software utilised by Bolt for the provision of rideshare services.

Draw Date - means by the 10th day of each month.

Driver and/or Drivers – refers to the person providing Transportation Services via the Bolt Platform who is an SPSV licensed vehicle Driver in England and Wales and holds a valid Driver Account.

Driver Account – means active private hire driver Accounts considered validly in operation by Bolt.

Eligible Journeys - means completed (i.e. not cancelled) journeys arranged exclusively via the Bolt driver app that are not associated with any irregular activity as is set out in our Driver FAQ (click here to read a copy).

Participant – is an eligible Driver referred to in these definitions and described in clause 3.

Programme - Refers to the Bolt Spring Driver of the Month giveaway.

Programme Period – means 12:00 am on the 1st April 2023 to 11:59 pm on 30th June 2023.

STCs – refers to the Special Terms and Conditions referred to in this document.

Transportation Services – means a Fleet Partner / Driver who provides transportation services to a Passenger through the Bolt App. All transportation services dispatched under these STCs must be made by SPSV licensed Driver, in compliance with all laws, tariffs and tariff rules relating to transportation by taxi, as applicable from time to time.

Winner - also collectively referred to as Winners, means the Participants who have completed at least 100 Eligible Journeys during the Programme Period and if their Driver Score resides in the top 10% of all Bolt Drivers in the UK.

All capitalised terms, which are not defined otherwise, will have the meanings set out in the General Terms and Conditions for Fleet Partners/Drivers in the United Kingdom, which can be located here.

3. Participants in the Programme

3.1. All Drivers who meet the eligibility requirements described below will automatically be included in the Programme and shall be considered a “Participant” at the absolute discretion of Bolt.

3.1.1. Drivers who are already active on the Bolt Platform and new Drivers who have their Bolt Driver Account activated during the Programme Period qualify as Participants;

3.1.2. All Participants must have a valid phone number and email address registered to their Bolt Driver Account;

3.1.3. Participants must comply with all relevant applicable laws in England and Wales;

3.1.4. Only natural persons with full legal capacity can enrol in the Programme;

3.1.5. Participants who have completed at least 100 Eligible Journeys during the Programme Period and if their Driver Score resides in the top 10% of all Bolt Drivers in the UK. More information on how Bolt’s Driver Score is calculated can be found in our Driver FAQs; and

3.1.6. Participants must have completed the Eligible Journeys between 00:00 GMT on the first day of each month in 2023 and 23:59 GMT at the month’s end (the “Programme Period”).

3.2. Bolt reserves the right to refuse participation in the Programme to:

3.2.1. Any Driver who does not comply with these STCs or our Additional Terms;

3.2.2. Any Driver who has previously violated our Additional Terms;.

3.2.3. Any Driver who engages in fraudulent activity or gives rise to suspicion of fraudulent activity on the Bolt Platform;

3.2.4. Any Driver whose conduct is contrary to the spirit or intent of the Programme;and

3.2.5. Any Driver that hasn’t been selected for the purpose of this Programme.

3.3. Bolt reserves the right to withhold any prize to any Driver that engages in fraudulent activity, or gives rise to suspicion of fraudulent activity on the Bolt Platform. If Bolt discovers that a Driver has engaged in any fraudulent activity or related dealings, Bolt reserves the right to withhold any prizes for investigation and is entitled to report the Driver’s conduct to the police, transport regulator or any other relevant law enforcement bodies.

3.4. Participants may opt out of the Programme by contacting Bolt at London@bolt.eu.

3.5. Bolt reserves the right to terminate the Programme at its absolute discretion at any time. If the Programme is terminated throughout the Programme Period, all Drivers accept that their accumulated finished rides at that date do not give them an automatic right to prizes, it will be up to Bolt to determine whether prizes are allocated on termination of the Programme.

4. How to Enter

4.1. All of our private hire Drivers will automatically be enrolled into the prize draws set out in paragraph 3 provided that they have complied with the eligibility criteria where a Driver’s Score resides in the top 10% and have completed the requisite number of Eligible Monthly Journeys of 100 during the Programme Period as set out in clause 3.

4.2. Bolt does not accept any claim and will not have any liability for Participants entries which are not successfully recorded or completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite network or server failure of any kind. Bolt does not accept any responsibility for entries not successfully completed due to a technical fault.

4.3. The number of finished rides that Bolt believes to be fraudulent will not be counted. Any suspicion of fraud will result in immediate disqualification from the Programme. Bolt will determine which activities are considered fraudulent in its sole discretion. Bolt's decision that an activity is fraudulent is final.

5. Winners

5.1. During the Programme Period, there will be three Winners in total selected for each monthly prize draw.

5.2. The Winners will be selected randomly by Bolt on or shortly after the Draw Date.

6. Prize Draws

6.1. The prizes awarded to the Winners will be dependent on the number of Eligible Journeys made during the Programme Period.

6.2. A Driver will be entered into this draw in accordance with paragraph 3 and by completing at least 100 Eligible Journeys during the Programme Period and if their Driver Score resides in the top 10% of all Bolt Drivers in the UK.

6.3. During the entire Programme Period a Participant has a maximum of one entry into each prize draw and may only win a single prize in each prize draw.

6.4. All entries are subject to compliance with the entry criteria. Participants can win a separate prize if they fulfil the required monthly criteria the following month or thereafter.

6.5. The prizes for the Winners cannot be exchanged or transferred for any other alternative prize.

__How the winners be notified __

6.6. Winners will be notified that they have won, this notification will specify which prize has been won. We aim to notify the Winners as soon as reasonably possible after the Draw Date. Winners will be contacted by telephone or email using the contact details provided to us via the Bolt Driver App (either at the time of activation or as amended since then). It is your responsibility as a Participant to make sure your contact details on the Bolt Driver App are up-to-date.

6.7. The Winner has 3 business days to accept the prize. If the prize is rejected, or if the Winner is subsequently found to be ineligible for a prize, they will be disqualified, and the next Participant who meets the criteria will be selected randomly.

6.8. Bolt’s decisions regarding any aspect of the prize draws are final and binding.

__How the prizes will be paid __

6.9. Once the Winners have been successfully contacted and their identity has been verified by us, we will pay each Winner’s prize to their nominated bank account (being the bank account given at the time of activation or as updated since then on the Bolt Driver App). It is your responsibility to ensure that your bank details on the Bolt Driver App are correct if you wish to participate in the prize draws. Bolt will not be held liable and does not accept any claim resulting from any incorrect bank details in the Bolt Driver App.

__7. Personal Data and Publicity __

7.1. Bolt will process Participants’ personal data for the purpose of this Programme in accordance with Bolt’s Privacy Policy (available here).

7.2. By accepting the Prize, the Winner consents to the Programmes Terms and Conditions and Bolt publishing or making available his/her name, likeness, image and/or voice (including photograph and video recording of the same) and country in Bolt’s website and any other marketing channels, including social media channels and newsletters. Bolt may be required to provide the Winner’s information and winning entry to a regulatory authority on request.It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form to be determined by Bolt in its absolute discretion.

7.2.1. We may be required to either publish or make available information that indicates that a valid award following the prize draws took place. To comply with this obligation we will send the surname and country of all major prize Winners and, if applicable, copies of their winning entries, to anyone who emails us at uk-driver@bolt.eu by no later than 31 January 2024. If you object to any or all of your surname, country and winning entry being published or made available, please contact us by emailing uk-driver@bolt.eu. In such circumstances, Bolt reserves the right to publish the Winners first initial and surname. Bolt must still provide the information and winning entry to the Advertising Standards Authority on request.

7.2.2. By accepting the Prize, the Winner consents to the Programmes Terms and Conditions and Bolt publishing or making available his/her name, likeness, image and/or voice (including photograph and video recording of the same) and country in Bolt’s website and any other marketing channels, including social media channels and newsletters. Bolt may be required to provide the Winner’s information and winning entry to a regulatory authority on request.It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form to be determined by Bolt in its absolute discretion.

8. General Conditions

8.1. The Programme will be run by Bolt who will be responsible for determining the prize draws.

8.2. In addition to Bolt's other reserved rights referred to in these STCs, Bolt reserves the right not to make public the number of finished rides awarded to Winners.

8.3. Bolt does not accept any claim relating to the selection of Winners nor any liability, direct or indirect, special or consequential, arising in any way from the Programme.

8.4. The interpretation of these STCs and Additional Terms for Drivers rests exclusively with Bolt, which reserves the right to change such terms from time to time.

8.5. Bolt further reserves the right to change, limit or terminate the Programme in its sole discretion.

8.6. As far as it is permitted by law, Bolt, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Bolt, its agents or distributors or that of their employees. In particular, Bolt will not be liable for any obligation you have in respect of any events beyond its reasonable control, any tax implications or liabilities of any Winners of a prize.

8.7. Any Driver who participates in the prize draws will be deemed to have accepted and agreed to be bound by these terms and conditions upon entry into the prize draws or if the Driver takes any steps to claim a prize or otherwise participate in the prize draws.

8.8. Bolt reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

8.9. Bolt reserves the right to hold void, cancel, suspend, or amend the prize draws where it becomes necessary to do so.

8.10. The prize draws will be governed by the law of England and Wales and Participants to the prize draw submit to the exclusive jurisdiction of the courts of England and Wales.

9. Applicable legislation and resolution

9.1. In the event that any of the provisions of these STCs are found to be totally or partially ineffective, this decision will not affect the validity of the remaining parts of these STCs and Additional Terms.

9.2. These STCs will be governed by and interpreted in accordance with laws of England and Wales and the parties submit to the non-exclusive jurisdictional competence of the courts of England and Wales.

9.3. Any dispute that may arise in relation to these STCs, Additional Terms and the Programme, whether concerning their existence, validity, interpretation, performance, breach, termination or other matters, shall be resolved through negotiations. If any dispute resulting from these STCs, Additional Terms and the Programme cannot be resolved through negotiation, the dispute must be resolved in the courts of England and Wales.
