Rinkodaros kampanijos terminai ir sąlygos 

Bendroji informacija 

1. „Bolt Food“ 2023 m. atvirukų kampaniją (toliau – kampanija) organizuoja „Bolt Operations OÜ“, įsikūrusi adresu Vana-Lõuna tn 15, 10134 Tallinn, Estija, registracijos kodas 14532901.
2. Kampanija vyks Lietuvoje, nuo 2023-05-29 iki 2023-06-11 imtinai (toliau – kampanijos laikotarpis).
3. Kampanija bus vykdoma pagal šiuos rinkodaros kampanijos terminus ir sąlygas bei nuostatas, nurodytas reklaminėje bei papildomoje kampanijos medžiagoje. Šių sąlygų privalo laikytis visi dalyviai.
4. Visi naudotojai, turintys asmeninę „Bolt Food“ programėlės kliento paskyrą ir atitinkantys „Bolt“ klientams taikomus terminus ir sąlygas, pateiktus adresu https://food.bolt.eu/lt-LT/legal, gali dalyvauti kampanijoje (toliau – dalyvis).
5. Norint dalyvauti kampanijoje, nebūtina registruotis iš anksto, tačiau reikia sutikti laikytis šių rinkodaros kampanijos terminų ir sąlygų (naudotojai sutinka, kad, jei laimės prizą, jų vardas ir pavardė bus skelbiami „Bolt“ interneto svetainėse, klientams siunčiamuose pranešimuose, el. laiškuose ir socialinių tinklų kanaluose).

Dalyvavimas kampanijoje

1. Norėdamas dalyvauti kampanijoje, jos laikotarpiu dalyvis turi įvesti kampanijos reklaminį kodą (VASARA), pateikdamas bent vieną (1) užsakymą restoranui arba „Bolt Market“ parduotuvei, prie kurių pavadinimų „Bolt Food“ platformoje rodomas jaustukas (💌). Siekiant išvengti abejonių, užsakymas turi būti atliktas (negali būti atšauktas ar pan.), tik tokiu atveju laikoma, kad kampanijos reklaminis kodas buvo panaudotas.
2. Panaudojus reklaminį kodą, iki 3 EUR nuolaida pristatymams iš pažymėtų restoranų bus taikoma iki kampanijos pabaigos datos. Prisijungus iš vienos paskyros ir suvedus reklaminį kodą, pristatymų skaičius negali viršyti 100. Viso, kampanijos metu, kodas gali būti panaudotas iki 5000 kartų. Reklaminis kodas taikomas tik užsisakant iš restoranų ir „Bolt Market“, prie kurių pavadinimo „Bolt Food“ platformoje rodomas kampanijos jaustukas (💌).

Prizas  

1. Vienas dalyvis, kuris kampanijos laikotarpiu įves kampanijos nuolaidos kodą ir pateiks daugiausia užsakymų, įvykdytų „Bolt Food“ platformos restoranuose, prie kurių pavadinimų rodomas kampanijos jaustukas, laimės „AirGuru“ dovanų kuponą, kurio vertė yra 500,00 (penki šimtai) eurų (toliau – prizas). Prizą suteikia ir jo naudojimo sąlygas nustato paslaugas teikianti trečioji šalis.
2. Prizas nekeičiamas jokiu būdu, „Bolt“ nekompensuoja jokių išlaidų, susijusių su prizo gavimu.

Laimėtojo išrinkimas

1. Vieną (1) dalyvį, kuris kampanijos laikotarpiu įves kampanijos nuolaidos kodą ir pateiks daugiausia užsakymų, kuriuos įvykdys „Bolt Food“ platformos restoranai arba „Bolt Market“, prie kurių pavadinimų rodomas kampanijos jaustukas, „Bolt“ paskelbs prizo laimėtoju. Laimėtojas bus paskelbtas 2023-06-19. Kampanijos laimėtojo vardas ir pavardė bus paskelbti „Bolt“ tinklaraštyje, interneto svetainėje, pranešimuose klientams, el. laiškuose ir (arba) socialinių tinklų kanaluose.
2. Jei daugiau kaip vienas (1) dalyvis bus pateikę didžiausią įvykdytų užsakymų skaičių, „Bolt“ atsitiktine tvarka paskelbs vieną (1) laimėtoją iš dalyvių, kurie kampanijos laikotarpiu, įvedę kampanijos reklaminį kodą, pateikė vienodą didžiausią skaičių užsakymų „Bolt Food“ platformos restoranams, prie kurių pavadinimų buvo rodomas kampanijos jaustukas.
3. „Bolt“ darbuotojai ir įmonės, priklausančios tai pačiai grupei kaip „Bolt“, taip pat jų artimiausi šeimos nariai negali laimėti prizo. 

Privatumas

1. Kampanijos metu dalyvių duomenis „Bolt“ tvarko siekdama užtikrinti kampanijos sąlygų laikymąsi, vykdyti savo teisinius įsipareigojimus ir siekti savo teisėtų interesų pagal 2016 m. balandžio 27 d. Europos Parlamento ir Tarybos reglamento (ES) 2016/679 dėl fizinių asmenų apsaugos tvarkant asmens duomenis ir dėl laisvo tokių duomenų judėjimo ir kuriuo panaikinama Direktyva 95/46/EB (Bendrojo duomenų apsaugos reglamento) 6 straipsnio 1 dalies c ir f punktus. Asmens duomenis būtina tvarkyti siekiant paskelbti dalyvio vardą ir pavardę bei įteikti prizą. „Bolt“ yra dalyvio asmens duomenų valdytoja. 
2. Bendrovei „Bolt“ duomenys pateikiami savanoriškai, tačiau to nepadarius „Bolt“ gali nepavykti susisiekti su kampanijos laimėtoju. Asmens duomenis „Bolt“ gali perduoti įgaliotajam duomenų tvarkytojui, kuris rinks prizo laimėtoją. Jei kampanija vykdoma socialinių tinklų platformoje (pvz., „Facebook“, „Instagram“, bet jomis neapsiribojant), „Bolt“ dalyviai tvarkys savo socialinio tinklo profilį ir veiklą socialiniuose tinkluose (skelbimas, paspaudimai „Patinka“, komentavimas). Be to, dalyvio duomenis „Bolt“ gali bendrinti su kitais „Bolt“ grupės juridiniais asmenimis, internetinių saugojimo debesyje paslaugų teikėjais, kitų svarbiausių IT bei rinkodaros paslaugų teikėjais. „Bolt“ taip pat gali būti įpareigota dalyvio asmens duomenimis bendrinti su valdžios institucijomis, turinčiomis teisę tvarkyti asmens duomenis. Kai „Bolt“ bendrina duomenis su savo tiekėjais, esančiais už ES ar EEE ribų, asmens duomenys perduodami tik remiantis tinkamu teisiniu pagrindu, o „Bolt“ imasi atitinkamų apsaugos priemonių, pvz., laikosi standartinių sutarčių sąlygų arba Europos Komisijos priimto sprendimo dėl tinkamumo.
3. Duomenys gaunami tiesiogiai iš dalyvio ir per papildomus įrankius ar programėles, naudojamus kampanijai vykdyti (pvz., „Vasaros atvirukai“).
4. Dalyvis turi teisę prašyti susipažinti su asmens duomenimis, juos ištaisyti ar ištrinti, apriboti asmens duomenų tvarkymą arba nesutikti, kad duomenys būtų tvarkomi, taip pat jis turi teisę į duomenų perkeliamumą. Kai dalyvio duomenys tvarkomi gavus sutikimą, dalyvis turi teisę bet kuriuo metu sutikimą atšaukti. Pasinaudojimas šia teise neturi poveikio sutikimu grindžiamo duomenų tvarkymo iki jo atšaukimo teisėtumui. Jei kyla neišspręstų problemų, susijusių su privatumu, dalyvis turi teisę pateikti skundą duomenų apsaugos institucijai.
5. Kilus bet kokių klausimų apie „Bolt“ duomenų tvarkymo praktiką, dalyvis turėtų atsiųsti laišką paštu bendrovei „Bolt“ adresu „Bolt Operations OÜ“, Vana-Lõuna tn 15, Tallinn 10135. Su „Bolt“ duomenų apsaugos pareigūnu dalyvis gali susisiekti elektroninio pašto adresu privacy@bolt.eu.
6. Dalyvio asmens duomenys bus saugomi tol, kol prizas bus įteiktas laimėtojui. Prizą įteikus laimėtojui, „Bolt“ laimėtojo vardą ir pavardę saugos vienus metus, kad juos galėtų paskelbti medijos priemonėse, reklamoje ir tada, kai tai susiję su kitais „Bolt“ įvykiais, kai to reikia siekiant vykdyti teisinius įsipareigojimus tokį laikotarpį, koks numatytas teisės aktuose.
7. Jei dalyvaudamas kampanijoje dalyvis nurodo trečiojo asmens duomenis (pvz., paskelbia trečiosios šalies nuotrauką, bet tuo neapsiribojama), dalyvis turi gauti aiškų trečiosios šalies sutikimą, kad trečiojo asmens duomenys būtų naudojami šios kampanijos tikslais. 

Draudžiama veikla

1. Dalyvis negali užsiimti jokia nesąžininga, neetiška ar neteisėta veikla, veikla, kuri, „Bolt“ vertinimu, nėra skaidri, taip pat veikla, kurios metu tyčia ar netyčia piktnaudžiaujama kampanijos sąlygomis ar apeinami jos apribojimai.
2. Dalyvis taip pat negali rodyti ir perduoti jokios medžiagos (tiesiogiai ar netiesiogiai, pvz., per nukreipimo nuorodą ar bet kurią medijos priemonę):
   • kuri yra netinkama, neetiška, grasinanti, piktnaudžiaujanti ar įžeidžianti kito asmens privatumą, sukelia susierzinimą, nepatogumą ar nepagrįstą nerimą;
   • kuri gali būti naudojama siekiant priekabiauti, nuliūdinti, sugėdinti, suerzinti kitą asmenį ar priversti supykti;
   • kurioje apsimetama bet kuriuo asmeniu, klaidingai nurodoma dalyvio tapatybė ar ryšys su bet kuriuo asmeniu;
   • kuri sudaro įspūdį, kad ta medžiaga gauta iš „Bolt“, išskyrus atvejus, kai medžiagą „Bolt“ specialiai pateikia dalyviui;
   • kuri kenkia „Bolt“ reputacijai.

Įsipareigojimai ir kita informacija

1. Dalyvaudamas kampanijoje dalyvis patvirtina, kad perskaitė šiuos rinkodaros kampanijos terminus ir sąlygas, taip pat sutinka jų laikytis.
2. Dėl force majeure aplinkybių „Bolt“ turi teisę nutraukti kampaniją iš anksto neįspėjusi ir be jokių pasekmių. Jei įmanoma, „Bolt“ praneš apie tokį nutraukimą „Bolt“ tinklaraštyje, interneto svetainėje, pranešimuose klientams, el. laiškuose ir (arba) socialinių tinklų kanaluose.
3. „Bolt“ pasilieka teisę, apie tai iš anksto nepranešusi, priimti bet kokius sprendimus dėl kampanijos, įskaitant vienašališką šių rinkodaros kampanijos terminų ir sąlygų pakeitimą bei papildymą. Tokius sprendimus dėl kampanijos „Bolt“ paskelbs „Bolt“ tinklaraštyje, interneto svetainėje, pranešimuose klientams, el. laiškuose ir (arba) socialinių tinklų kanaluose.
4. „Bolt“ turi teisę, iš anksto neįspėjusi, pašalinti dalyvį iš kampanijos, jei dalyvis pažeidžia šios rinkodaros kampanijos terminus ir sąlygas.
5. „Bolt“ neatsako už jokias trečiosios šalies sukeltas triktis, dėl kurių dalyvis negali dalyvauti kampanijoje.
6. Visi skundai, susiję su kampanijos organizavimu, iki kampanijos laikotarpio pabaigos turi būti siunčiami bendrovei „Bolt“ el. pašto adresu giveaways@bolt.eu. „Bolt“ nenagrinės skundų dėl kampanijos, jei jie bus išsiųsti pasibaigus kampanijos laikotarpiui. 

General Terms and Conditions

1. Bolt Operations OÜ, address Vana-Lõuna tn 15, 10134 Tallinn, Estonia, registry code 14532901 is the organiser of the campaign Postcards from Bolt Food 2023 (Campaign).
2. The Campaign will be held in LITHUANIA at the specified start and end date 29.05.2023 to 11.06.2023 (inclusive) (Term of the Campaign).
3. The procedure of the Campaign is established in current Marketing Campaign Terms and Conditions and in the conditions specified in the promotional and additional materials of the Campaign, which are mandatory for all Participants.
4. All users who have a personal Bolt Food App Client account, who comply with Bolt’s Terms and Conditions for Clients available at https://food.bolt.eu/en-US/legal are eligible to take part in the Campaign (Participant).
5. Prior registration for the Campaign is not required; however, in order to participate in the Campaign, the Participant must accept current Marketing Campaign Terms and Conditions (incl. prize-winners consenting to having their name published on the websites of Bolt, in client communications, emails and social media channels).

Participation in the Campaign

6. To participate in the Campaign, the Participant must use promotional code related to the Campaign (“VASARA”) when completing at least one (1) order during the Term of the Campaign at a restaurant  with the emoji related to the Campaign displayed in the name of the restaurant (💌) in the Bolt Food Platform or by completing at purchase on Bolt Market App during the Term of the Campaign. For the avoidance of doubt, the order must be completed (not canceled or similar) for the use of the promotional code to be taken into account in the Campaign.
7. Discount of up to 3 EUR for 14 days will apply to the delivery in case of using the promotional code. The promotional code can be used up to 100 times per user. The maximum number of deliveries with the promotional code is 5000 in total. The promotional code will only work on restaurants which have the emoji related to the Campaign displayed in their name (💌) in the Bolt Food Platform and on Bolt Market.

Prize  

8. One Participant who has completed the highest number of orders with the promotional code related with the Campaign at the Bolt Food Platform restaurant which has the emoji associated with the Campaign displayed in its name during the Term of the Campaign, can win an AirGuru gift card worth 500.00 (five hundred) euros (the Prize). The terms for use of the Prize will be set by the third party service provider. 
9. The Prize is not replaceable or exchangeable in any way and Bolt shall not reimburse any expenses related to receiving the Prize.
10. The Prize will be gross of any income taxes, charges and other similar levies. The participant shall be liable for reporting and paying personal income taxes and other similar taxes relating to receiving the prize, as applicable.

Identifying the winner

11. Bolt will identify one (1) Participant who has completed the highest number of orders with the promotional code related to the Campaign at the Bolt Food Platform restaurant which has the emoji associated with the Campaign displayed in its name or on Bolt Market App during the Term of the Campaign as a winner of the Prize. The winner will be announced on 19.06.2023. The name of the winner of the Campaign will be published on Bolt’s blog, website, in client communications, e-mails and/or social media channels. 
12. Should it be the case that there will be more than one (1) Participant who has completed the highest number of orders, then Bolt identifies the winned by drawing one (1) winner at random among those Participants having equally highest number of orders with the promotional code related with the Campaign at the Bolt Food Platform restaurant which has the emoji associated with the Campaign displayed in its name during the Term of the Campaign.
13. Employees of Bolt and companies belonging to the same group as Bolt, as well as their immediate family members, are not eligible to win the Prize. 

Privacy

14. In the Campaign, Bolt processes data of the Participant in order to fulfil the conditions of the Campaign, to comply with its legal obligations and to pursue its legitimate interests, pursuant to Article 6 (1) (c) and (f) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). The processing of personal data is necessary in order to announce the name of the Participant and for the purpose of awarding the Prize. Bolt is a data controller of Participant’s personal data 
15. The data is provided to Bolt voluntarily, but failing to do so may lead to Bolt not being able to contact the winner of the Campaign. Bolt may transfer personal data to an authorized processor, who will draw Prizes. If the campaign is run on a social media platform (such as, but not limited to Facebook, Instagram) Bolt participants will process their social media profile and social media activity (posting, liking, commenting). Bolt may also share Participant’s data with other entities within Bolt group, providers of online cloud storage services and other essential IT services and providers of marketing services. Bolt may also be obliged to share Participant’s personal data with public authorities authorized to process personal data. Where Bolt shares data with its suppliers located outside of the EU or EEA, such transfer of personal data will take place only upon appropriate legal basis, and Bolt will take appropriate protective measures such as standard contractual clauses or the adequacy decision issued by the European Commission.
16. The data is acquired directly from the Participant and via additional tooling or applications used to conduct the Campaign such as Vasaros atvirukai.
17. The Participant has a right to request access to and rectification or erasure of personal data or restriction of processing of personal data or to object to processing as well as the right to data portability. Where a Participant’s data is processed on the basis of a consent, the Participant has a right to withdraw it at any time, without affecting the lawfulness of processing based on consent before its withdrawal. In case of any unresolved privacy concerns, the Participant has the right to complain to a data protection authority.
18. For any queries related to Bolt’s processing practices, the Participant may contact Bolt by post at Bolt Operations OÜ, Vana-Lõuna tn 15, Tallinn 10135. The Participant may contact Bolt’s Data Protection Officer electronically at privacy@bolt.eu. 
19. The personal data of the Participant will be kept until the winner is presented with the Prize. After the Prize is presented to the winner, Bolt will only retain the winner’s first and last name for one year for use in the media, advertising and other Bolt-related events, as appropriate and where required- for the purposes of complying with legal obligations for the duration of statutory retention periods.
20. Should the Participant ibe using third person’s personal data while participating in the Campaign (for example, but not limited to, posting a photo of a third party) then this Participant has to obtain a clear acceptance from this third party for use third person’s personal data for the purposes of this Campaign. 

Prohibited activities

21. The Participant will not engage in any fraudulent, unethical or unlawful activity, any activity which is not transparent to Bolt, or any activity that intentionally or unintentionally misuses or circumvents the Campaign. 
22. The Participant will also not display or transmit any material (either directly or indirectly, for example through a referral link or any other media) that:
    1. is inappropriate, unethical, threatening, abusive or invasive of another’s privacy, or causes annoyance, inconvenience or needless anxiety;
    2. is likely to harass, upset, embarrass, alarm or annoy any other person;
    3. impersonates any person, or misrepresents Participants identity or affiliation with any person;
    4. gives the impression that such material emanates from Bolt unless specifically given to Participant by Bolt for that purpose; or
    5. is detrimental to Bolt’s reputation.

Obligations/Other

23. By participating in the Campaign, the Participant confirms that he/ she has read and agrees to current Marketing Campaign Terms and Conditions.
24. Should circumstances of force majeure appear, Bolt shall have the right to discontinue the Campaign without prior notice or any consequences. If possible, Bolt shall provide notice of such discontinuation through Bolt’s blog, website, in client communications, e-mails and/or social media channels.
25. Bolt reserves the right to make any decisions regarding the Campaign, including to unilaterally change and supplement current Marketing Campaign Terms and Conditions, without prior notice thereof. Bolt will publish such decisions regarding the Campaign via Bolt’s blog, website, in client communications, e-mails and/or social media channels. 
26. Bolt has the right to remove the Participant from the Campaign without prior notice should the Participant infringe current Marketing Campaign Terms and Conditions. 
27. Bolt is not responsible for any faults caused by a third party which prevents the Participant from participating in the Campaign. 
28. All complaints related to the organisation of the Campaign must be presented to Bolt via following e-mail giveaways@bolt.eu during the Term of the Campaign. Bolt will not process complaints regarding the Campaign which will be sent after the Term of the Campaign.
