These General Terms for Items Delivery for TVDE Operators are set out in accordance with and in addition to the Terms and Conditions for TVDE Operators and Privacy Policies, and define the conditions for using Items delivery via the Bolt App.

Estes Termos Gerais de Entrega de Itens para Operadores TVDE são estabelecidos de acordo com e para além dos Termos e Condições aplicáveis a Operadores TVDE e das Políticas de Privacidade, e definem as condições de utilização da Entrega de Itens através da Aplicação Bolt.

Anything not covered by these General Terms for Items Delivery for TVDE Operators, shall be governed by Terms and Conditions for TVDE Operators and Privacy Policies. In case of any contradictions regarding Items Delivery, the conditions set forth in these General Terms for Items Delivery for TVDE Operators shall prevail. The provisions of the Terms and Conditions for TVDE Operators equally apply to the TVDE Operators under these General Terms for Items Delivery for Clients.

Tudo o que não estiver abrangido pelas presentes Condições Gerais de Entrega de Itens para Operadores TVDE será regido pelos Termos e Condições aplicáveis aos Operadores TVDE e pelas Políticas de Privacidade. Em caso de contradição relativamente à Entrega de Itens, prevalecem as condições estabelecidas nas presentes Condições Gerais de Entrega de Itens para Operadores TVDE. As disposições dos Termos e Condições para Operadores TVDE aplicam-se igualmente aos Operadores TVDE ao abrigo dos presentes Termos Gerais de Entrega de Itens para Clientes.

By using the Bolt App for providing Items delivery services each TVDE Operator respectively agrees to the application and content of these General Terms for Items Delivery for TVDE Operators as well as to the processing of the personal data on the conditions incorporated to these General Terms for Items Delivery for TVDE Operators and Privacy Policy for TVDE Operators.

Ao utilizar a aplicação Bolt para fornecer serviços de entrega de Itens, cada Operador TVDE concorda, respetivamente, com a aplicação e o conteúdo destes Termos Gerais de Entrega de Itens para Operadores TVDE, bem como com o processamento dos dados pessoais nas condições incorporadas nestes Termos Gerais de entrega de Itens para Operadores TVDE  e na Política de Privacidade para Operadores TVDE.

1. DEFINITIONS

1. DEFINIÇÕES

1.1. Bolt App - a smartphone application for drivers and passengers to request and receive transportation services.

1.1. App Bolt – uma aplicação para smartphones para motoristas e passageiros solicitarem e receberem serviços de transporte.

1.2. Bolt Platform – the mobility and delivery platforms operated by Bolt.

1.2. Plataforma Bolt - as plataformas de mobilidade e entrega operadas pela Bolt.

1.3. Cancellation Fee - a fee charged to the Client for cancelling the use of an ordered service, including Transportation Services, after a certain time from the acceptance of the Client’s order, as indicated in clause 4.3 of the Terms and Conditions for Passengers and in the Bolt App, ​​and a fee charged to the Client by the TVDE Operator for cancelling the delivery of the Excluded Items or unsuitable packages, as indicated in clause 2.6.

1.3. Taxa de Cancelamento - taxa cobrada ao Cliente pelo cancelamento da utilização de um serviço encomendado, incluindo os Serviços de Transporte, após um determinado período de tempo a partir da aceitação da encomenda do Cliente, conforme indicado na cláusula 4.3 dos Termos e Condições para Passageiros e na App Bolt, e uma taxa cobrada ao Cliente pelo Operador TVDE pelo cancelamento da entrega dos Items Excluídos ou pacotes inadequados, conforme indicado na cláusula 2.6.

1.4. Client – means a user of the Bolt App that has ordered a delivery of an Item via the Bolt App and thereby enters into a Delivery Agreement with the TVDE Operator.

1.4. Cliente - significa um utilizador da aplicação Bolt que encomendou uma entrega de um Item através da aplicação Bolt e, assim, celebra um Acordo de Entrega com o Operador TVDE.

1.5. Delivery Agreement – means the agreement between the Client and the TVDE Operator for the delivery of the Item.

1.5. Acordo de Entrega - significa o acordo entre o Cliente e o Operador TVDE para a entrega do Item.

1.6. Drop-Off Location – means the address where the Client wishes the Item to be delivered.

1.6. Local de Entrega - significa o endereço onde o Cliente deseja que o Item seja entregue.

1.7. Pick-Up Location - means the address where the Client wishes the Item to be collected.

1.7. Local de Recolha - significa o endereço onde o Cliente deseja que o Item seja recolhido.

1.8. Excluded Items – means items not permitted to be transferred under the Delivery Agreement as detailed at clause 2.5. 

1.8. Itens Excluídos - significa os itens que não podem ser transferidos ao abrigo do Acordo de Entrega, conforme detalhado na cláusula 2.5. 

1.9. General Terms for Items Delivery for Clients – means these terms and conditions applicable to the relationship between Bolt and the Client in relation to the use of the Bolt App by the Client for Items delivery.

1.9. Termos gerais para entrega de Itens para Clientes - significa os presentes termos e condições aplicáveis à relação entre a Bolt e o Cliente em relação à utilização da aplicação Bolt pelo Cliente para entrega de Itens.

1.10. Item – means the item subject to the delivery, with the exception of the Excluded Items listed in clause 2.5. below.

1.10. Item - significa o artigo objeto da entrega, com exceção dos Itens Excluídos indicados na cláusula 2.5. abaixo.

1.11. Recipient – means the person (including the agent or representative of a legal person) who is located at the Drop-off Location or, where applicable, within a nearby adjacent area, subject to its designation by any means by the Client.

1.11. Destinatário - é a pessoa (incluindo o agente ou representante de uma pessoa colectiva) que se encontra no Local de Entrega ou, se for caso disso, numa zona adjacente próxima, sob reserva da sua designação por qualquer meio pelo Cliente.

1.12. Transportation Services – transport service a TVDE Operator is providing to the Client whose request the TVDE Operator has accepted through the Bolt App.

1.12. Serviços de transporte - serviço de transporte que um Operador TVDE está a prestar ao Cliente cujo pedido o Operador TVDE aceitou através da aplicação Bolt.

1.13. User – means either the Client or the TVDE Operator as the context requires.

1.13. Utilizador - significa o Cliente ou o Operador TVDE, consoante o contexto.

1. LEGAL FRAMEWORK

2. ENQUADRAMENTO LEGAL

2.1. The Bolt App enables the Client to order delivery of the Item to the Recipient at a Drop-Off Location by selecting the “Bolt Delivery'' category in the Bolt App. 

2.1. A app Bolt permite ao Cliente encomendar a entrega do Item ao Destinatário num local de entrega, selecionando a categoria "Entrega Bolt" na aplicação Bolt. 

2.2. TVDE Operators may opt into the “Bolt Send” category in the Bolt App. Once the TVDE Operator has opted into the “Bolt Send” category, the TVDE Operator is bound by these General Terms for Item Delivery for TVDE Operators. TVDE Operators are under no obligation to opt in for the “Bolt Send” category.

2.2. Os Operadores TVDE podem optar pela categoria "Bolt Send" na aplicação Bolt. Uma vez que o Operador TVDE tenha optado pela categoria "Bolt Send", o Operador TVDE fica vinculado a estes Termos Gerais de Entrega de Itens para Operadores TVDE. Os Operadores TVDE não são obrigados a optar pela categoria "Bolt Send".

2.3. For the delivery of the Item, the TVDE Operator enters into a Delivery Agreement directly with the Client. The Delivery Agreement is deemed to be concluded from the moment the order for delivery of a Item is confirmed by the TVDE Operator via the Bolt App. 

2.3. Para a entrega do Item, o Operador TVDE celebra um Acordo de Entrega diretamente com o Cliente. O Acordo de Entrega é considerado concluído a partir do momento em que a ordem de entrega de um Item é confirmada pelo Operador TVDE através da aplicação Bolt. 

2.4. By operating the Bolt App, Bolt acts only as a provider of the information society service and is not a party to the Delivery Agreement. Bolt is not the provider of the delivery services, and is not liable in any way for the performance under the Delivery Agreement. Bolt does not supervise, direct or control the manner in which the delivery of the Item is carried out by the TVDE Operator.

2.4. Ao operar a aplicação Bolt, a Bolt atua apenas como fornecedor do serviço da sociedade da informação e não é parte do Acordo de Entrega. A Bolt não é o fornecedor dos serviços de entrega e não é responsável de forma alguma pela execução do Acordo de Entrega. A Bolt não supervisiona, dirige ou controla a forma como a entrega do Item é efectuada pelo Operador TVDE.

2.5. Bolt App may not be used for ordering delivery of items containing goods that have not been identified as eligible for the Bolt App (the "Excluded Items"). The Excluded Items include:

2.5. A aplicação Bolt não pode ser utilizada para encomendar a entrega de itens que contenham bens que não tenham sido identificados como elegíveis para a aplicação Bolt (os "Itens Excluídos"). Os itens excluídos incluem:

2.5.1. goods that do not fit comfortably in the TVDE Operator’s vehicle cabin or goods that weigh more than 20 kg;

2.5.1. mercadorias que não caibam confortavelmente na cabina do veículo do Operador TVDE ou mercadorias que pesem mais de 20 kg;

2.5.2. animals, human beings and other living or dead creatures, including their parts, remains, fluids or substances derived from products originating from animals, human beings or other creatures;

2.5.2. Animais, seres humanos e outras criaturas vivas ou mortas, incluindo as suas partes, restos, fluidos ou substâncias derivadas de produtos provenientes de animais, seres humanos ou outras criaturas;

2.5.3. bank notes (including foreign currency), credit cards, securities, jewellery, gift vouchers and similar valuables;

2.5.3. notas de banco (incluindo moeda estrangeira), cartões de crédito, títulos, jóias, cheques-prenda e objectos de valor semelhantes;

2.5.4. firearms and their parts, ammunition, melee weapons, other items specially designed for attack and defence (e.g knuckles, stilettos);

2.5.4. armas de fogo e suas partes, munições, armas brancas, outros objectos especialmente concebidos para ataque e defesa (por exemplo, soqueiras, estiletes);

2.5.5. flammable, combustible, explosive and radioactive or other ionising substances, munitions, gas, infectious, poisonous or corrosive materials which by their nature may pose danger to the environment;

2.5.5. substâncias inflamáveis, combustíveis, explosivas e radioativas ou outras substâncias ionizantes, munições, gases, materiais infecciosos, venenosos ou corrosivos que, pela sua natureza, possam constituir um perigo para o ambiente;

2.5.6. drugs and other psychotropic substances which are subject to special control in accordance with the legislation;

2.5.6. drogas e outras substâncias psicotrópicas sujeitas a controlo especial nos termos da legislação;

2.5.7. food, alcohol beverages, ethyl alcohol, high-octane oxygen containing impurities, tobacco;

2.5.7. alimentos, bebidas alcoólicas, álcool etílico, oxigénio de alta octanagem contendo impurezas, tabaco;

2.5.8. goods,  the value of which exceeds 250 EUR;

2.5.8. bens cujo valor exceda 250 EUR;

2.5.9. stolen goods;

2.5.9. bens roubados;

2.5.10. fragile items;

2.5.10. itens frágeis;

2.5.11. other items that are not allowed to be delivered, transported by law and items that cannot be transported, delivered without additional licences, permits, approvals etc, including goods which cannot be delivered due to the limitations pertaining either to the Client or the Recipient (e.g medicine which requires medical prescription).

2.5.11. outros objectos que não podem ser entregues, transportados por lei e objectos que não podem ser transportados, entregues sem licenças, autorizações, aprovações adicionais, etc., incluindo mercadorias que não podem ser entregues devido a limitações do Cliente ou do Destinatário (por exemplo, medicamentos que requerem prescrição médica).

2.6. The Drivers at the service of TVDE Operator may cancel the delivery of a Item if the TVDE Operator upon pick up discovers or has reasons to think that the Item is an Excluded Item or is not suitable for delivery. In such cases, Cancellation Fee will be charged by the TVDE Operator to the Client. The TVDE Operator acknowledges that the delivery of the Excluded Item may bring about administrative or criminal liability.

2.6. Os motoristas ao serviços de Operador TVDE pode cancelar a entrega de um Item se, no momento da recolha, descobrir ou tiver razões para pensar que o Item é um Item Excluído ou não é adequado para entrega. Neste caso, o Operador TVDE cobrará uma taxa de cancelamento ao Cliente. O Operador TVDE reconhece que a entrega de um Item Excluído pode dar origem a responsabilidade administrativa ou criminal.

2.7.  The TVDE Operator shall indemnify, defend or settle and hold Bolt harmless against any loss or damage (including legal costs) which Bolt may sustain or incur, in relation to any third party claim, to the extent such claim is based upon any breach by the TVDE Operator of the provisions of these General Terms for Items Delivery for TVDE Operators.

2.7.  O Operador TVDE deverá indemnizar, defender ou resolver e isentar a Bolt de qualquer perda ou dano (incluindo custos legais) que a Bolt possa sofrer ou incorrer, em relação a qualquer reclamação de terceiros, na medida em que tal reclamação se baseie em qualquer violação pelo Operador TVDE das disposições destes Termos Gerais para Entrega de Itens para Operadores TVDE.

2.8. The TVDE Operator is liable for the performance of the Delivery Agreement and for any claims presented under the Delivery Agreement. Bolt is not liable for any failure or non-conformity of performing the Delivery Agreement and assumes no liability for any traffic violations or accidents sustained during the performance of the Delivery Agreement.

2.8. O Operador TVDE é responsável pela execução do Acordo de Entrega e por quaisquer reclamações apresentadas ao abrigo do Acordo de Entrega. A Bolt não é responsável por qualquer falha ou não conformidade na execução do Acordo de Entrega e não assume qualquer responsabilidade por quaisquer infrações de trânsito ou acidentes ocorridos durante a execução do Acordo de Entrega.

2.9. If the Client files a claim due to the breach of the Delivery Agreement, the TVDE Operator shall release Bolt from all liability regarding the claim.

2.9. Se o Cliente apresentar uma reclamação devido ao incumprimento do Acordo de Entrega, o Operador TVDE isenta a Bolt de qualquer responsabilidade relativamente à reclamação.

2.10. The TVDE Operator’s total liability for material damage or consequential loss, such as loss, theft, material damage, average or destruction of the items of the Item shall be the greater of (i) the original value of the affected items of the Item; or (ii) the amount of their repair or reconstitution, in both cases up to the limit of equivalent of 250 EUR.

2.10. A responsabilidade total do Operador TVDE por danos materiais ou perdas consequentes, tais como perda, roubo, danos materiais, média ou destruição dos itens do Item será o maior de (i) o valor original dos itens afetados do Item; ou (ii) o montante da sua reparação ou reconstituição, em ambos os casos até ao limite equivalente a 250 EUR.

2.11. The Bolt App is provided to the User strictly on an "as is" basis. Bolt will not be liable for any interruptions, connection errors, unavailability of, or faults in the Bolt App. In no event shall Bolt's aggregate liability for any and all claims arising out of the use of the Bolt App by the same Client, including those based on tort, agreement or other grounds, exceed the equivalent of 500 EUR or the amount of the fees paid to Bolt, whichever is lower.

2.11. A aplicação Bolt é fornecida ao Utilizador estritamente numa base "como está". A Bolt não será responsável por quaisquer interrupções, erros de conexão, indisponibilidade ou falhas na aplicação Bolt. Em nenhum caso a responsabilidade agregada da Bolt por todas e quaisquer reivindicações decorrentes do uso da aplicação Bolt pelo mesmo cliente, incluindo aquelas baseadas em delito, acordo ou outros motivos, excederá o equivalente a 500 EUR ou o valor das taxas pagas à Bolt, o que for menor.

2.12. The TVDE Operators are free to accept and refuse to pick up or deliver the Item before the acceptance of the order for any reason. Once accepted, the TVDE Operator has committed to the Client to deliver the Item and the refusal to deliver the Item may only be based on the grounds set out in clauses 2.5 and 2.6 of these General Terms for Item Delivery for TVDE Operators, or on the reasons set out in the General Terms for TVDE Operators.

2.12. Os Operadores TVDE são livres de aceitar e recusar a recolha ou a entrega do Item antes da aceitação da encomenda, por qualquer motivo. Uma vez aceite, o Operador TVDE compromete-se perante o Cliente a entregar o Item e a recusa de entrega do Item só pode ter por base os motivos indicados nas cláusulas 2.5 e 2.6 das presentes Condições Gerais de Entrega de Itens para Operadores TVDE, ou os motivos indicados nas Condições Gerais para Operadores TVDE.

1. ORDERING DELIVERY OF ITEMS THROUGH THE BOLT APP

3. ENCOMENDAR A ENTREGA DE ITENS ATRAVÉS DA APLICAÇÃO BOLT

3.1. The Client shall order a delivery of the Item by the TVDE Operator to the Recipient at the Drop-Off Location. The Client and the TVDE Operator will enter into the Delivery Agreement upon confirmation of the order by the TVDE Operator.

3.1. O Cliente encomenda a entrega do Item pelo Operador TVDE ao Destinatário no Local de Entrega. O Cliente e o Operador TVDE celebram o Contrato de Entrega após a confirmação da encomenda pelo Operador TVDE.

3.2. The TVDE Operator shall deliver the Item to the Drop-Off Location communicated by the Client to the TVDE Operator upon placing the order.

3.2. O Operador TVDE deve entregar o Item no Local de Entrega comunicado pelo Cliente ao Operador TVDE aquando da encomenda.

3.3. In case of a failure to hand over the Item due to the Client and/or Recipient in accordance with clause 2.12., the TVDE Operator shall contact the Client through Bolt App and wait for at least 10 minutes on the Drop-Off Location. If after waiting for the said time, the TVDE Operator is not able to deliver the Item, the TVDE Operator should return to the Pick-Up Location and deliver the Item to the Client. After handing over the Item to the Client and marking the delivery as “Finished”, the TVDE Operator should request through the Bolt App a price review.   Bolt’s customer service can be contacted for questions  regarding the Item delivery. 

3.3. Em caso de não entrega do Item ao Cliente e/ou ao Destinatário, de acordo com a cláusula 2.12., o Operador TVDE deverá contactar o Cliente através da aplicação Bolt e esperar pelo menos 10 minutos no Local de Entrega. Caso, após decorrido o tempo de espera, o Operador TVDE não conseguir entregar o Item, o Operador TVDE deve voltar ao Local de Recolha e entregar o Item ao Cliente. Após entregar o Item ao Cliente e selecionar a entrega como “Concluída”, o Operador TVDE deve pedir através da aplicação Bolt uma revisão de preço. O serviço de Apoio ao Cliente da Bolt pode ser contactado para questões relacionadas com a entrega do Item.

3.4. Bolt, on behalf of the TVDE Operator, may cancel the delivery and fully charge the Client for the delivery if the Recipient is not available at the Drop-Off Location within 10 minutes of the arrival of the TVDE Operator thereto.

3.4. A Bolt, em nome do Operador TVDE, pode cancelar a entrega e cobrar integralmente a entrega ao Cliente se o Destinatário não estiver disponível no Local de Entrega no prazo de 10 minutos após a chegada do Operador TVDE ao mesmo.

3.5. The TVDE Operator is prohibited from adding or removing any packaging and has to deliver the Item as prepared by the Client. The TVDE Operator is not allowed to change, modify, add to, remove from or tamper with the Item in any way and ensure the Item is not damaged, destroyed, stolen or lost as well as act responsibly in the driving of its means of transport.

3.5. O Operador TVDE está proibido de acrescentar ou retirar qualquer embalagem e tem de entregar o Item tal como foi preparado pelo Cliente. O Operador TVDE não está autorizado a alterar, modificar, acrescentar, remover ou adulterar o Item de qualquer forma e a garantir que o Item não é danificado, destruído, roubado ou perdido, bem como a atuar de forma responsável na condução do seu meio de transporte.

3.6. Bolt reserves the right to facilitate payment for the reasonable charges associated with the delivery, return, redelivery or disposal of the Client’s Item on behalf of the TVDE Operator using any of the Client’s payment methods selected in the Bolt App, including Bolt Balance. Such amounts will be transferred by Bolt to the applicable TVDE Operator. 

3.6. A Bolt reserva-se o direito de facilitar o pagamento dos encargos razoáveis associados à entrega, devolução, reentrega ou eliminação do Item do Cliente em nome do Operador TVDE, utilizando qualquer um dos métodos de pagamento do Cliente selecionados na aplicação Bolt, incluindo o Saldo Bolt. Esses montantes serão transferidos pela Bolt para o Operador Bolt aplicável. 

3.7. Cash payments are excluded while using the Items delivery service via the Bolt App.

3.7. Os pagamentos em numerário estão excluídos aquando da utilização do serviço de Entrega de Itens através da aplicação Bolt.

1. CANCELLATION AND SUSPENSION OF USE

4. ANULAÇÃO E SUSPENSÃO DA UTILIZAÇÃO

4.1. Bolt is entitled to remove the TVDE Operator from the Bolt App with immediate effect and/or refuse or cancel any deliveries of any Itens, if it causes any abuse or harm to the Bolt App, if Bolt has reasonable belief of fraudulent acts by the TVDE Operator when using the Bolt App, or if the TVDE Operator otherwise fails to comply with its obligations under these General Terms for Items Delivery for TVDE Operators (e.g. failing to deliver the Item to the Recipient for the reasons not pertaining to the Client or the Recipient at least two times or damaging the Item during the delivery).

4.1. A Bolt tem o direito de remover o Operador TVDE da aplicação Bolt com efeito imediato e/ou recusar ou cancelar quaisquer entregas de quaisquer Itens, se este causar qualquer abuso ou dano à aplicação Bolt, se a Bolt tiver uma crença razoável de actos fraudulentos por parte do Operador TVDE ao usar a aplicação Bolt, ou se o Operador TVDE não cumprir as suas obrigações ao abrigo destes Termos Gerais de Entrega de Itens para Operadores TVDE (por exemplo, não entregar o Item ao Destinatário por razões não pertencentes ao Cliente ou ao Destinatário pelo menos duas vezes ou danificar o Item durante a entrega).

4.2. The TVDE Operator may not use the Bolt App for any unlawful purpose, including for the purposes of money laundering. If the TVDE Operator violates this clause, Bolt may permanently suspend the TVDE Operator from using the Bolt App.

4.2. O Operador TVDE não pode usar a aplicação Bolt para qualquer finalidade ilegal, incluindo para fins de lavagem de dinheiro. Se o Operador TVDE violar esta cláusula, a Bolt pode suspender permanentemente o Operador TVDE de usar a aplicação Bolt.

1. FINAL PROVISIONS

5. DISPOSIÇÕES FINAIS

5.1. Bolt may amend these General Terms for Items Delivery for TVDE Operators from time to time. We will inform you of any changes within a reasonable time period by sending a respective notice. Please feel free to stop using the Items delivery services if you do not agree with the updated terms. If you continue using the Items delivery after the reasonable time period as of the receipt of the notice, you are considered to have accepted the updated terms.

5.1. A Bolt pode alterar estas Condições Gerais de Entrega de Itens para Operadores TVDE ocasionalmente. Informá-lo-emos de quaisquer alterações dentro de um período de tempo razoável, enviando um aviso respectivo. Pode deixar de utilizar os serviços de entrega de Itens se não concordar com os termos atualizados. Se continuar a utilizar a entrega de Itens após o período de tempo razoável a contar da receção do aviso, considera-se que aceitou os termos actualizados.

5.2. Nothing in these General Terms for Items Delivery for TVDE Operators limits and excludes any liability which cannot legally be limited or excluded, including liability for death or personal injury caused by negligence and liability for fraud or fraudulent misrepresentation or alter your rights as a consumer that cannot be excluded under applicable law.

5.2. Nada nas presentes Condições Gerais de Entrega de Itens para Operadores TVDE limita e exclui qualquer responsabilidade que não possa ser legalmente limitada ou excluída, incluindo a responsabilidade por morte ou danos pessoais causados por negligência e a responsabilidade por fraude ou deturpação fraudulenta ou alteração dos seus direitos como consumidor que não possa ser excluída ao abrigo da legislação aplicável.

5.3. Bolt reserves the right to terminate the Items delivery category in its sole discretion in the Bolt App at any time. Bolt will notify you of such termination in advance.

5.3. A Bolt reserva-se o direito de rescindir a categoria de entrega de Itens, a seu exclusivo critério, na aplicação Bolt a qualquer momento. A Bolt irá notificá-lo de tal rescisão com antecedência.
