Germany Fleet Owner Survey Terms and Conditions

1. Bolt Operations OÜ, address Vana-Lõuna tn 15, 10134 Tallinn, Estonia, registry code 14532901 (“Bolt”) is the organiser of the survey (“Survey”).

2. The Survey will be conducted in Germany at the specified start and end date 30.09.2024 to 4.10.2024 (inclusive) (“Term of the Survey”).

3. By taking part in this Survey you are agreeing to these terms and conditions (“Terms”) as a driver providing transportation services on the Bolt App (“Driver”) and are subject to the terms and conditions imposed to you by your Passenger Transport Company, including the relevant terms and conditions derived from the General Terms and Conditions for Passenger Transport Companies available here.

4. At the end of the Term of the Survey Bolt will conduct a draw (“Draw”) to randomly select one Driver from all eligible Drivers as a winner of the Draw with the help of the automated computer software.

5. All Drivers who have the Bolt Driver Account in the Bolt App and are actively providing transportation services on the Bolt App, comply with the General Terms and Conditions applicable to them and are located in Germany are eligible to take part in the Survey and Draw.

6. Prior registration for the Survey and Draw is not required.

7. To participate in the Draw, the Driver must:

a. accept these Terms;

b. provide their contact details to Bolt;

c. complete the Survey during the Term of the Survey (all questions within the provided Survey need to be completed to remain eligible).

8. A Driver completing the Survey outside of the Term of the Survey is not eligible to participate in the Draw.

1. One winner of the Draw will receive a voucher in the sum of up to €50 to be used at any time for goods and services of the providers specified for the voucher (“Prize”). The Prize will be sent to the winner by email within 5 working days as of announcing the winner.

9. The Prize is not replaceable or exchangeable in any way.

10. The Prize will be gross of any income taxes, charges and other similar levies. The participant shall be liable for reporting and paying personal income taxes and other similar taxes relating to receiving the Prize, as applicable.

11. The Driver will automatically enter the Draw provided that the conditions set out in clauses 5 and 7 are met. Only one Survey completed by a Driver will make the Driver completing it to be eligible to participate in the Draw and allow to win the Prize.

12. You confirm that by participating in the Draw you are eligible to do so and eligible to claim the Prize you may win as a Driver.

13. The winner will be selected on 10.10.2024.

14. The winner will be contacted using the email address provided by the winner in the Survey in order to provide the Prize. Bolt reserves the right to use alternative means of delivering the Prize to the winner.

15. Employees of Bolt and companies belonging to the same group as Bolt, as well as their immediate family members, are not eligible to win the Prize.

16. Bolt is not responsible for incorrect or incomplete contact details being provided by a Driver.

10. Bolt reserves the right to substitute a promo code with another prize of equal or higher value if circumstances beyond Bolt’s control make it necessary to do so.

11. To complete the Survey you require internet access. Completion of the Survey involves using hardware, software and internet access. Your ability to complete the Survey may be affected by the performance of these. You agree that such requirements are your own responsibility and Bolt does not hold responsibility for Survey accessibility.

12. Bolt does not accept any liability for any damage, loss, injury or disappointment suffered by any Drivers as a result of either participating in the Draw or Survey or being selected for the Prize, save that Bolt does not exclude its liability for death or personal injury as a result of its own negligence as required by law only.

13. By participating in the Survey and Draw, the Driver confirms that he/she has read and agrees to these Terms.

14. Should circumstances of force majeure appear, Bolt shall have the right to discontinue the Draw and/or Survey without prior notice or any consequences. If possible, Bolt shall provide notice of such discontinuation through Bolt’s blog, website, in client communications, e-mails and/or social media channels.

15. Bolt reserves the right to make any decisions regarding the Survey and Draw, including to unilaterally change and supplement current Terms, without prior notice thereof. Bolt will publish such decisions regarding the Survey and Draw via Bolt’s blog, website, in client communications, e-mails and/or social media channels.

16. Bolt has the right to remove the Driver from the Draw without prior notice should the Driver infringe these Terms.

17. Bolt is not responsible for any faults caused by a third party which prevents the Driver from participating in the Survey and/or Draw.

18. All complaints related to the organisation of the Survey and Draw must be presented to Bolt via following e-mail giveaways@bolt.eu during the Term of the Survey, but in any case no later than 15 calendar days after the end of the Term of the Survey. Bolt will not process complaints regarding the Survey and Draw which will be sent after the aforementioned timeline.

19. Any disputes or legal actions arising from or in connection with these Terms that could not be resolved peacefully shall be subject to the jurisdiction of the competent courts located in Germany.

20. The Driver will not engage in any fraudulent, unethical or unlawful activity, any activity which is not transparent to Bolt, or any activity that intentionally or unintentionally misuses or circumvents the Survey and/or Draw.

21. The Driver will also not display or transmit any material (either directly or indirectly, for example through a referral link or any other media) that:

a. is inappropriate, unethical, threatening, abusive or invasive of another’s privacy, or causes annoyance, inconvenience or needless anxiety;

b. is likely to harass, upset, embarrass, alarm or annoy any other person;

c. impersonates any person, or misrepresents Drivers’ identity or affiliation with any person;

d. gives the impression that such material emanates from Bolt unless specifically given to Driver by Bolt for that purpose; or

e. is detrimental to Bolt’s reputation.

22. Data relating to the winner(s) and eligible Drivers, will only be used in accordance with Bolt’s existing Privacy Notice in order to facilitate this Survey and Draw between Bolt and Drivers, as well as to analyse Survey`s results as per Bolt`s legitimate interest in improving Bolt’s surveys. All rights available under current data protection law are reserved. Individual Driver’s data will not be publicly disclosed to third parties without a Driver’s express consent. Bolt may share personal data with other entities within Bolt group, providers of online cloud storage services, and other essential IT services under appropriate international data transfer safeguards of the applicable law such as standard contractual clauses. Safeguard details can be requested at privacy@bolt.eu. Bolt will process the Driver's personal data until the purposes of processing cease to exist, but not longer than for 12 months. Bolt reserves the right to make aggregated results of the survey publicly available but will honour the anonymity of the individual Drivers involved at all times in a public domain and no Driver will be identifiable.
