Giveaway - Campaign Terms and Conditions

1. The Giveaway

These Campaign Terms and Conditions (“Terms”) govern the participation in the “Win a Decathlon gift card” (“Giveaway”), organized by Bolt Operations OÜ. Participation in the Giveaway is subject to these Terms.

This Giveaway will run from 09.12.2024 to 15.12.2024 (the “Giveaway Period”). All capitalised terms, which are not defined otherwise, will have the meanings set out in the Bolt Food General Terms.

2. Participants in the Giveaway

2.1. All Delivery Partners who meet the following eligibility requirements will automatically be included in the Giveaway and shall be considered a “Participant”:

2.1.1. has a valid phone number and email address registered to their valid and active Delivery Partner account on the Bolt Food platform; and

2.1.2. has completed at least 30 deliveries of Orders during the Giveaway Period.

2.1.3. Bolt reserves the right to refuse participation in the Giveaway to any Delivery Partner who does not comply or has previously breached these Terms or Bolt Food General Terms or whose conduct is contrary to the spirit or intent of the Giveaway.

2.2. Participants may opt out of the Giveaway at any time by contacting Bolt at latvia-food@bolt.eu.

2.3. Bolt reserves the right to terminate the Giveaway at its absolute discretion at any time without notice. If the Giveaway is terminated throughout the Giveaway Period, all Delivery Partners accept that it will be up to Bolt to determine whether Prizes are allocated on termination of the Giveaway.

3. How to Enter

3.1. All Participants will automatically be entered into the Prize draws provided that they have complied with the eligibility criteria set out in these Terms. Prior registration for the Campaign is not required.

3.2. Bolt does not accept any liability for Participants entries which are not successfully recorded or completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite network or server failure of any kind.

3.3. Each Participant is limited to one entry for this Giveaway.

4. Winners and Prize(s)

4.1. During the Giveaway Period, there will be 15 winners in total selected for the Prize. The winners will be selected by random draw performed by a computer process on 18.12.2024. (“Draw Date”).

4.2. The prizes (“Prize(s)”) awarded to the winners will be:

4.2.1. €100 gift cards from Decathlon (15 in total)

4.3. The Prize for the winners is as stated and no cash or other alternatives will be offered. The Prize cannot be exchanged and is not transferable.

4.4. Bolt shall not reimburse any expenses related to giving the Prize. There are no hidden fees for the Winner related to getting the Prize.

4.5. It is not possible for a single Participant to win multiple times.

4.6. Winners will be notified that they have won within a reasonable time period. Winners will be contacted by telephone or email using the contact details provided to us via the Delivery Partner’s Bolt Food account. It is your responsibility as a Participant to make sure your contact details are up-to-date.

4.7. The winners have 3 business days to accept the Prize. If the winners cannot be contacted, the Prize is rejected, or if a winner is subsequently found to be ineligible for a Prize, they will be disqualified. Bolt reserves the right to withdraw the Prize from a winner.

4.8. By accepting the price, the winner agrees that Bolt can use their name and/or image in any post or related marketing activity relating to this Giveaway.

4.9. Bolt’s decisions regarding any aspect of the Prize draws are final and binding.

5. Privacy

5.1. Bolt includes the Participants in the Campaign pursuant to its legitimate interests in rewarding them for their performance as Delivery Partners. To determine and announce the winners who meet the Campaign conditions, Bolt will additionally process personal data in accordance with GDPR Article 6.1 (b).

5.2. For the purposes of the Campaign, Bolt will only utilize personal data already processed by Bolt pursuant to its privacy notices available at https://bolt.eu/en/privacy/. Specific metrics processed to determine the winners include: 30 number of finished deliveries or Orders.

5.3. The data related to Participants will be reviewed by a human, and this processing will not result in automated individual decision-making as defined by Article 22 of the GDPR.

5.4. In the course of the Campaign, Bolt will share Participant`s personal data with third parties. Such third parties include other entities within Bolt group, providers of online cloud storage services, and other essential IT services. In case Bolt receives a legal request from a public authority, it may also be obliged to share Participant’s personal data with them.

5.5. Where Bolt shares Participant`s data outside of the EU or EEA, such transfer of Participant`s personal data will take place only under an adequacy decision adopted by the European Commission or upon appropriate safeguards such as standard contractual clauses. Details of these safeguards can be requested at privacy@bolt.eu.

5.6. The Participant has a right to request access to and rectification or erasure of personal data or restriction of processing of personal data or to object to processing as well as the right to data portability. Where a Participant's personal data is processed on the basis of a consent, the Participant has a right to withdraw it at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

5.7. In case of any unresolved privacy concerns, the Participant has the right to complain to a data protection authority. To exercise their privacy rights, the Participant can utilize the form available at https://bolt.eu/en/privacy/data-subject/.

5.8. For any queries related to Bolt’s processing practices, the Participant may contact Bolt by post at Bolt Operations OÜ, Vana-Lõuna tn 15, Tallinn 10134. The Participant may contact Bolt’s Data Protection Officer electronically at privacy@bolt.eu.

5.9. Bolt will use the Participant's personal data required for the purposes of the Campaign until the Winner is announced. The Participant’s personal data will continue to be processed and retained for other purposes as indicated in our privacy notices at https://bolt.eu/en/privacy/.

5.10. Should the Participant be using third person’s personal data while participating in the Campaign, then this Participant has to ensure that the Participant has the appropriate legal basis for sharing this data with Bolt under the applicable privacy law.

6. General Conditions

6.1. The procedure of the Campaign is established in current Terms and in any conditions specified in the promotional and additional materials of the Campaign, which are mandatory for all Participants.

6.2. This Campaign is not a lottery or any other form of gambling.

6.3. Bolt does not accept any claim relating to the selection of winners nor any liability, direct or indirect, special or consequential, arising in any way from the Giveaway.

6.4. Bolt reserves the right to change, limit or terminate the Giveaway at any time, without notice in its sole discretion. Bolt reserves the right to hold void, cancel, suspend, or amend the prize draws where it becomes necessary to do so.

6.5. The prize draws will be governed by the law of Estonia and Participants submit to the exclusive jurisdiction of the courts of Estonia.
